Comand was Given to y^e Sher^f. of Kent County y^e 23 day of Sep^r. Anno Domⁱ. 1701 that
he Take William Miller if found in his bailiwick & him Safe keepe Soe that he have his body
before his Maj^ties Justices at y^e next Court to be held for Said County to answer unto Thomas
Rynggold of A plea of Trespass upon y^e Case
Att which next Court viz^t. y^e 25. day of Novem^r. Annoq Domⁱ. 1701 y^e day of y^e returne of S^d.
writt came Elias King high Sher^f. of Said County & made returne thereof thus Endorsed viz^t.
                                                                            Non East p^r Elias King Sher^f.
But a Copie of y^e Declⁿ. & Acc^t. goeing along w^th. y^e writt
and left at y^e last place of y^e Defend^ts. Abode according as y^e Law Directs was as followeth viz^t
Kent County    Ss    W^m Miller Stands Attached to Answer unto Thomas Rynggold of A plea of Trespass
in Maryland                 upon y^e Case
And whereupon y^e Said Thomas Rynggold by Richard Macklin his Att^ry complaineth & Saith that
whereas y^e Said Thomas Rynggold in y^e yeare of our Lord 1701 at Kent County within y^e jurisdiction of
Court At y^e Esp^ll. Instance & request of y^e Said W^m Miller had Sold & delivered unto y^e Said
W^m Miller divers goods wares &merchandizes Amounting to y^e Sume of Eleaven hundred & Ninety
pounds of Tob^o. and alsoe at y^e like instance & request of y^e Said William Miller in y^e yeare Afs^d.
and within y^e jurisdiction Afs^d. y^e Said Thomas Rynggold lent unto him y^e Said W^m four Shill^s
& Six pence currant money of this province y^e which goodss Sold & money lent y^e Said money
being rated in Tob^o. at one peney p^r pound amounts in y^e whole to y^e Sume of Twelve hundred
forty & four pounds of Tob^o. as by an Acc^t. thereof to this Declⁿ. Annexed and here into Court
brought y^e Same appeares In consideracon whereof y^e Said W^m Miller upon himselfe
Assumed & unto y^e Said Thomas Rynggold then & there faithfully promised that he y^e S^d. W^m
Miller y^e Said Sume of 1244 Tob^o. unto y^e Said Thomas Rynggold well & Truly he would
content & pay when thereunto afterwards required and albeit y^e Said W^m hath paid &
Satisfied unto y^e Said Thomas Rynggold y^e Sume of five hundred pounds of Tob^o. in part of
y^e Said Sume of 1244 of Tob^o. yet as to y^e residue thereof being Seaven hundred forty & four
pounds of Tob^o. he hath not paid altho Often by y^e Said Thomas Thereunto required but
plotting contriving & knavishly Designing y^e Said Thomas in that behalfe Craftily &
and Subtilly to deceive & defraud y^e Said Sume of 744^lb. of Tob^o. residue as Afs^d. he hath
not paid but y^e Same to pay hath denyed & refused & Still doth deny & refuse & unjustly
detaine to y^e Damage of y^e Said Thomas Rynggold one Thousand four hundred forty and
Eight pounds of Tob^o. & thereupon he brings this Suite    Macklin p^r q^r. pleadg Jn^o Doe

The copie of which Declⁿ. & Acc^t. being Sent w^th. y^e writt & left at last place of y^e Said Def^t.
abode according to act of Assembly ~ ~ ~ The Said plaint^f. moves y^e Court by his Said Att^ry that
he may have Judg^t. p^r Attachm^t. a^st. y^e goods Chattles or Creditts for y^e Said Debt &
cost accrewing which was Granted unto him
