Novemr. Court 1701 [84] Comand was Given to ye Sherf. of Kent County ye 23 day of Sepr. Anno Domi. 1701 that he Take William Miller if found in his bailiwick & him Safe keepe Soe that he have his body before his Majties Justices at ye next Court to be held for Said County to answer unto Thomas Rynggold of A plea of Trespass upon ye Case Att which next Court vizt. ye 25. day of Novemr. Annoq Domi. 1701 ye day of ye returne of Sd. writt came Elias King high Sherf. of Said County & made returne thereof thus Endorsed vizt. Non East pr Elias King Sherf. But a Copie of ye Decln. & Acct. goeing along wth. ye writt and left at ye last place of ye Defendts. Abode according as ye Law Directs was as followeth vizt Kent County Ss Wm Miller Stands Attached to Answer unto Thomas Rynggold of A plea of Trespass in Maryland upon ye Case And whereupon ye Said Thomas Rynggold by Richard Macklin his Attry complaineth & Saith that whereas ye Said Thomas Rynggold in ye yeare of our Lord 1701 at Kent County within ye jurisdiction of Court At ye Espll. Instance & request of ye Said Wm Miller had Sold & delivered unto ye Said Wm Miller divers goods wares &merchandizes Amounting to ye Sume of Eleaven hundred & Ninety pounds of Tobo. and alsoe at ye like instance & request of ye Said William Miller in ye yeare Afsd. and within ye jurisdiction Afsd. ye Said Thomas Rynggold lent unto him ye Said Wm four Shills & Six pence currant money of this province ye which goodss Sold & money lent ye Said money being rated in Tobo. at one peney pr pound amounts in ye whole to ye Sume of Twelve hundred forty & four pounds of Tobo. as by an Acct. thereof to this Decln. Annexed and here into Court brought ye Same appeares In consideracon whereof ye Said Wm Miller upon himselfe Assumed & unto ye Said Thomas Rynggold then & there faithfully promised that he ye Sd. Wm Miller ye Said Sume of 1244 Tobo. unto ye Said Thomas Rynggold well & Truly he would content & pay when thereunto afterwards required and albeit ye Said Wm hath paid & Satisfied unto ye Said Thomas Rynggold ye Sume of five hundred pounds of Tobo. in part of ye Said Sume of 1244 of Tobo. yet as to ye residue thereof being Seaven hundred forty & four pounds of Tobo. he hath not paid altho Often by ye Said Thomas Thereunto required but plotting contriving & knavishly Designing ye Said Thomas in that behalfe Craftily & and Subtilly to deceive & defraud ye Said Sume of 744lb. of Tobo. residue as Afsd. he hath not paid but ye Same to pay hath denyed & refused & Still doth deny & refuse & unjustly detaine to ye Damage of ye Said Thomas Rynggold one Thousand four hundred forty and Eight pounds of Tobo. & thereupon he brings this Suite Macklin pr qr. pleadg Jno Doe Rd. Roe
abode according to act of Assembly ~ ~ ~ The Said plaintf. moves ye Court by his Said Attry that he may have Judgt. pr Attachmt. ast. ye goods Chattles or Creditts for ye Said Debt & cost accrewing which was Granted unto him |
