Edward Rush having Entered into recognizance last Court for his personall appearance
at this Court & good behaviour in y^e meane time And being now Solemnly Called appeares
not but make Default

Walter Meeks comes into Court & Acknowledges himselfe Indebted unto our Soveraigne Lord
William y^e Third &^a. in the full & just Sume of Twenty pounds Ster^g. to be leavied upon his
Lands & Tenements goods & Chattles condiconed that he make not his personall appearance
here at y^e next Court & good behaviour to all his Maj^ties Leidge Subjects in y^e meane
time likewise came James Meeks & Thomas Covington his Security and acknowledge them:
:Selves Justly indebted unto our Said Soveraigne Lord y^e King &^a. in y^e full & just Sume
of Tenn pounds Ster^g. each to be leavied as Afs^d. condiconed as Afs^d. wherewith they are all
Contented

The Grand jury returne and are Discharged ~ ~ ~ And Ordered That they
have Creditt with Edward Fry For y^e Sume of four hundred pounds of Tob^o.

Comand was given to y^e Sher^f. of Kent County y^e 25. day of June Anno Domⁱ. 1701 that he
Take Nathan^ll. Cleave and Hanah his wife if found in his bailiwick & them Safe keepe Soe
that you have theire bodies before our Justices at y^e next Court to answer unto John
Fannen in A plea of Trespass upon y^e Case
Att which next Court viz^t. y^e 26. Day of Aug^t. following all actions were continued
untill y^e S^d next Court
Att which next Court viz^t. y^e 23^d. day of Sep^r. Annoq Domⁱ. 1701 came Elias King
high Sher^f. of Said County & made returne of Said writ Cepi Corpus p^r Elias King Sher^f
On which Said Day came y^e Said Nathan^ll. Cleave by Michael Earle his Att^ry & prayes
thereof to Imparle untill y^e next Court which was granted unto him y^e Same day was
given y^e plaint^f. alsoe
And now here at this day viz^t. y^e 27. day of Novem^r. Annoq Domⁱ. 1701 came as well
y^e Said Defend^t. by his Said Att^ry as alsoe y^e Said Plaint^f. by Richard Macklin his Att^ry
& Decalres as followes viz^t.
Kent Ss    Nathan^ll. Cleave and Hanah his Wife Stands Attached to answer unto John
                Fannen of A plea of Trespass upon y^e case
   And Whereupon y^e Said John by Richard Macklin his Att^ry complaynes & Sayes that where
as y^e Said John Fanin to Witt in y^e yeare An^o. Domⁱ. 1700 at Chester River in Kent County
within y^e jurisdiction of this Court at y^e Sp^ll. instance & request of y^e Said Hanah when Sole
had Sett up for y^e Said Hanah y^e quantity of Tree Tunn of Casque that is to Say Twelve
                                                                                                          Tob^o hogsheads
