Court 1701 Edward Rush having Entered into recognizance last Court for his personall appearance at this Court & good behaviour in ye meane time And being now Solemnly Called appeares not but make Default ~~~~~~~~~~~~~~~ Walter Meeks comes into Court & Acknowledges himselfe Indebted unto our Soveraigne Lord William ye Third &a. in the full & just Sume of Twenty pounds Sterg. to be leavied upon his Lands & Tenements goods & Chattles condiconed that he make not his personall appearance here at ye next Court & good behaviour to all his Majties Leidge Subjects in ye meane time likewise came James Meeks & Thomas Covington his Security and acknowledge them: :Selves Justly indebted unto our Said Soveraigne Lord ye King &a. in ye full & just Sume of Tenn pounds Sterg. each to be leavied as Afsd. condiconed as Afsd. wherewith they are all Contented ~~~~~~~~~~~~~~~ The Court Adjournes till Seaven A Clock to Morrow Morning Novemr. ye 27th. 1701 ~ ~ The Court againe Meets according to Adjournement

Thomas Smith Sitts ~ ~ ~ And Mr. Charles Hynson absent ~~~~~~~~~~~~~~~ The Grand jury returne and are Discharged ~ ~ ~ And Ordered That they have Creditt with Edward Fry For ye Sume of four hundred pounds of Tobo. ~~~~~~~~~~~~~~~ Jno Dowdall Clk Comand was given to ye Sherf. of Kent County ye 25. day of June Anno Domi. 1701 that he Take Nathanll. Cleave and Hanah his wife if found in his bailiwick & them Safe keepe Soe that you have theire bodies before our Justices at ye next Court to answer unto John Fannen in A plea of Trespass upon ye Case Att which next Court vizt. ye 26. Day of Augt. following all actions were continued untill ye Sd next Court Att which next Court vizt. ye 23d. day of Sepr. Annoq Domi. 1701 came Elias King high Sherf. of Said County & made returne of Said writ Cepi Corpus pr Elias King Sherf On which Said Day came ye Said Nathanll. Cleave by Michael Earle his Attry & prayes thereof to Imparle untill ye next Court which was granted unto him ye Same day was given ye plaintf. alsoe And now here at this day vizt. ye 27. day of Novemr. Annoq Domi. 1701 came as well ye Said Defendt. by his Said Attry as alsoe ye Said Plaintf. by Richard Macklin his Attry & Decalres as followes vizt. Kent Ss Nathanll. Cleave and Hanah his Wife Stands Attached to answer unto John Fannen of A plea of Trespass upon ye case And Whereupon ye Said John by Richard Macklin his Attry complaynes & Sayes that where as ye Said John Fanin to Witt in ye yeare Ano. Domi. 1700 at Chester River in Kent County within ye jurisdiction of this Court at ye Spll. instance & request of ye Said Hanah when Sole had Sett up for ye Said Hanah ye quantity of Tree Tunn of Casque that is to Say Twelve Tobo hogsheads |
