Novemr. Court 1701 [80] Hogsheads at ye rate & price of ninety pounds of Tobo pr each Tunn which in ye whole Amounts in ye whole to ye Sume of Two hundred and Seaventy pounds of Tobo. in consider :acon whereof ye Said Hanah when Sole upon herselfe assumed and unto ye ye Said John faithfully promised that She ye Said Hanah when thereunto Afterwards required ye Afsd. Sume of 270lb. Tobo. unto ye Said John She would pay well & truly and altho ye Said John Did allow unto ye Said Hanah ye Sume of Sixty pounds of Tobo. by way of abatement by reason that ye Three Tunn of Casque was not completely finished Yet as to ye residue being 210lb. Tobo. ye Afsd. Hanah when Sole and ye Afsd. Nathanll and Hanah After Espousalls between them celebrated little regarding ye Afsd. promise & Assumption of ye Afsd. Hanah whilst She was Sole Soe as Afsd. made but plotting contriving & fraudulently intending ye Said John in that behalfe craftily & Subtily to Deceive & defraud ye Afsd. Hanah when She was Sole nor ye Afsd. Nathll. & Hanah After Espousalls between them celebrated ye Afsd. 210lb. Tobo residue of ye Afsd. 270lb. Tobo. to ye Afsd John they have not as yet paid nor either of them hath paid altho ye Afsd. Hanah when Sole was by ye Said John often thereunto required and ye Said Nathanll. and Hanah in like maner after Espousalls between them celebrated by ye Afsd. John have been thereunto required whereupon he ye Said John Sayes that he is Damnified and hath Damage to ye Value of 400lb Tobo. and thereup :on he brings this Suite ~ ~ ~ Macklin pr qr. pleadges &a. Jno Doe Rd. Roe Anno 1700 in Maryland Hanah Cleaves Dr.
Non Assumpsit moda & forma pr patriam ~ ~ ~ Earle pr Defendant And the plaintf. in like maner Macklin pr Comand was Therefore given to ye Sherf. of Kent County that he cause to come here Twelve &a. by whome &a. who neither &a. to recognize &a who made answer he had there ready Twelve &a. as by his precept he was Comanded vizt Wm Sparkes Thomas Hyndes Thomas Puney Thomas Gwin Thomas Godwin John Hamer Nicholas Massey Wm Robinson Samll. Wallis Peter Peterson John Tylliard and Edwin Godwin which being duely Tryed & Sworne to Try ye Issue Joyned as above Said ye Court for Some reasons withdraw one of ye jurors and award judgemt. to ye Said Plaintf. for ye Said Debt & Cost of Suite Accrewing Therefore It is Considered by ye Court here vizt. this 27. day of Novemr Annoq Domi. 1701 that ye Said Plaintf. John Fannen doe recover from ye Said Defendants Nathanll. Cleave and Hanah his Wife as well ye Sume of Two hundred & Tenn pounds of Tobo. Debt as alsoe ye Sume of Six hundred & nineteen pounds of Tobo.
