[71?] vizt. foreasmuch as by A late resurvey of Ward Oake in ye North Side of Chester River in this County ye 12th. day of June last they have begun theire tree Resurvey at a bounded ^ beginning above ye Middle of A Mash which Seemeth contrary to ye beginning of ye Said Land as more at Large may Appeare, pr vera copia, of ye line of ye Said Land & now upon Record to be a manifest mistake in theire beginning and ye Same proceedings of ye Said Resurvey being likely to occasion great Damage to ye latter takers up of Land whose bounded trees are well knowne & to prevent future damages & confusions to ye owners of ye Adjacent Lands thereto Wee your Peticoners doe make our humble Addresses to this Worshipfull Court to enter A Caveat against ye Afsd. proceedings that ye bounds of ye Said Ward Oake may be better Ascertained & if noe bounded tree can be found to begin ye Said Land where ye Record Expresseth it that by another resurvey of ye Said Land A jury may find A point or prick to begin at about ye place where ye Record expresseth ye Said Land to being and as in duty bound Your peticonrs. Shall ever pray &a. The which peticon being read & by ye Court heard & Maturely considered It was thereupon ordered that ye Said Peticonrs have A Warrant of resurvey & A venire for a Jury According to theire peticon Jno Dowdall Clk ~~~~~~~~~~ Nicholas Clouds of Kent County comes into Court & Acknowledgeth A Deed to Robert Smith of Talbott County Esqr. for Eleaven hundred forty & four Acres of Land lying upon ye South Side of Chester River ~~~~~~~~~~ Read ye peticon of Katherine Inocence vizt. To ye worshippfull his Majties Justices of ye peace for Kent County The Humble peticon of Katherine Inocence in humble Manner Sheweth That Whereas yr. peticonr. having lived in this County this Severall yeares & have taken an honest care for a Livelyhood but now it pleased Allmighty God to Afflict your peticonr. with Sickness & lameness Soe that your peticoner is altogeather uncapable of getting any manner of livelyhood Yr. peticoner humbly craves your Worshipps to ye premisses Afsd. into your wise & tender consideracons and allow her what your Worshipps Shall think meet & convenient for her Support & mentainance until it Shall please God to restore her to her former health & limbs againe & as in duty bound your peticoner Shall ever pray ~~~~ &a. The which peticon being read & by ye Court Duly considered It was ordered that Wm Robinson have ye keeping of ye Said Katherine as he now desires, & that he have allowed him five hundred pounds of Tobo. out of ye County leavies this yeare Jno Dowdall Clk ~~~~~~~~~~ Maryland July ye 29. 1701 This is to whome it may concerne that I Thomas Marshall now Master of ye Ship Sarah of Biddeford doe hereby assigne Over to Mr. Robert Foreman of Chester River Owen Magrase wth. his wife & Daughter which now came into this province with me ye 25.
