The Said James y^e Said three hundred foot of plank out of his possession lost which Said plan[k]
afterwards that is to Say at Chester River Afs^d. within y^e jurisdiction Afs^d. y^e thirteenth day of March
Anno Domⁱ. 1698 by finding came to y^e hands & possession of y^e Said Hugh March & alsoe y^e Said Hugh knew
y^e Said plank to be y^e proper plank of y^e Said James & to him to belong & pertaine Yet y^e Said Hugh
devising & fraudulently intending y^e Said James in this behalfe craftily & Subtilly to decieve & defraud y^e Afs^d.
Six hundred foot of white oake plank altho often Afterwards demanded unto y^e Said James he hath not
delivered by y^e Same to him to deliver he hath & as Yet doth deny & refuse to y^e Damage of y^e Said James
Wattson Twelve hundred pounds of Tob^o. & thereupon he brings this Suite    Macklin p^r q^r. pledg    ^{Jn^o Doe}

James Wattson	And y^e Said Defend^t. by Michael Earle his Attorney comes & defends the force & injury when
ag^t.	&^a. And demurrs in Law to y^e plaint. declaracon
Hugh Marsh	And for cause of demurrer Saith that y^e plaint. in y^e Orriginall part of his Declⁿ. alleadgeth
	that he was possessed with three hundred foot of white oake plank of y^e price of Six hundr[ed]

pounds of Tob^o. which out of his possession he lost; & that Afterwards by finding Said plank came into the
hands & possession of Said Defendant, & that y^e Said Defend^t. refused to delvier y^e Said plaint. Six hundre[d]
foot of white oake plank altho often demanded &^a. being directly contrary to y^e rules of pleding y^e Said
Declⁿ having neither certainty nor verity &^a therein for which reason y^e Said Defendant prayes Judgem^t
if Action &^a                                                    Earle p^r Defendant

And y^e Said plaint. for replication Sayes his Declⁿ. is good & Sufficient to cause y^e Said Defend^t. to Answer
& thereupon prayes Judgem^t.                                          Macklin p^r q^r

The which Declⁿ. Demurrer & Replication being read and by y^e Court heard and fully Understood the
      Court gives y^e Said Defendant Hugh Marsh Judgem^t. against y^e Said plaint. for A Non Suite

Therefore it is Considered by y^e Court here Viz^t. y^e 28^th. day of November Annoq Domⁱ. 1700
      that y^e Said Defend^t. Hugh Marsh doe recover from y^e Said Plaint. James Wattson as well y^e Sume
of fifty pounds of Tob^o. for A Non Suite as alsoe y^e Sume of one hundred Eighty & Six pounds of Tob^o.

Comand was given to y^e Sher^f. of Kent County y^e 25. day of June Annoq Domini 1700 that he Take
John Hollinsworth Adm^r. of all & Singular y^e goods Chattles & creditts of John Hollinsworth late of Kent
County Dec^d. if he should be found in his bailiwick and him Safe Keep Soe that he have his body before his
his maj^ties Justices at y^e next Court to Answer unto Robert Gouldesborough of A plea that he render
him y^e Sume of Six hundred pounds of good Tob^o. &^a
Att which next Court Viz^t. the 27. day of Aug^t. Anno Domⁱ 1700 y^e day of y^e returne of Said
writt came Elias King high Sher^f. of Said County & made returne thereof in these words Viz^t.

On which Said Day came y^e Said Defendant by Michael Earle his Att^ry & prayes thereof to impar[le]
untill y^e next Court which was granted unto him & Same day was given y^e plaint likewise
The which cause being Cont. from Court to Court untill this p^rSent Court And now here at this
day Viz^t. y^e 28. day of Novem^r. Anno Domⁱ. 1700 came as well [y^e s^d Pl]aint. by Richard
Macklin his Att^ry as alsoe y^e Said Defend^t. by his Said Att^ry & y^e Said [Cause stan]ding for Tryall [y^e]
plaintiff Decl^s. Viz^t.

Kent Ss	John Hollinsworth Adm^r. of all & Singular y^e goods chattles and Cr[edits of] John Hollinsworth
	late of Kent County Dec^d. was Sumoned to Answer unto Robert Gouldesborough of A plea that
	he render him y^e Sume of Six hundred pounds of good Tob^o. which from him he Unjustly
	Dataines

And whereupon y^e Said Robert by Richard Macklin his Att^ry Sayes that whereas y^e Said John
dec^d. in his lifetime Att Talbott County within y^e jurisdiction of this Court in y^e Month of jan^ry Ann[o]
Domⁱ.
