The Said James ye Said three hundred foot of plank out of his possession lost which Said plan[k]
afterwards that is to Say at Chester River Afsd. within ye jurisdiction Afsd. ye thirteenth day of March
Anno Domi. 1698 by finding came to ye hands & possession of ye Said Hugh March & alsoe ye Said Hugh knew
ye Said plank to be ye proper plank of ye Said James & to him to belong & pertaine Yet ye Said Hugh
devising & fraudulently intending ye Said James in this behalfe craftily & Subtilly to decieve & defraud ye Afsd.
Six hundred foot of white oake plank altho often Afterwards demanded unto ye Said James he hath not
delivered by ye Same to him to deliver he hath & as Yet doth deny & refuse to ye Damage of ye Said James
Wattson Twelve hundred pounds of Tobo. & thereupon he brings this Suite    Macklin pr qr. pledg    Jno Doe

James Wattson    And ye Said Defendt. by Michael Earle his Attorney comes & defends the force & injury when
agt.    &a.    And demurrs in Law to ye plaint. declaracon
Hugh Marsh    And for cause of demurrer Saith that ye plaint. in ye Orriginall part of his Decln. alleadgeth

   that he was possessed with three hundred foot of white oake plank of ye price of Six hundr[ed]
pounds of Tobo. which out of his possession he lost; & that Afterwards by finding Said plank came into the
hands & possession of Said Defendant, & that ye Said Defendt. refused to delvier ye Said plaint. Six hundre[d]
foot of white oake plank altho often demanded &a. being directly contrary to ye rules of pleding ye Said
Decln having neither certainty nor verity &a therein for which reason ye Said Defendant prayes Judgemt
if Action &a                                                    Earle pr Defendant

And ye Said plaint. for replication Sayes his Decln. is good & Sufficient to cause ye Said Defendt. to Answer
& thereupon prayes Judgemt.                                          Macklin pr qr

The which Decln. Demurrer & Replication being read and by ye Court heard and fully Understood the
      Court gives ye Said Defendant Hugh Marsh Judgemt. against ye Said plaint. for A Non Suite

Therefore it is Considered by ye Court here Vizt. ye 28th. day of November Annoq Domi. 1700
      that ye Said Defendt. Hugh Marsh doe recover from ye Said Plaint. James Wattson as well ye Sume
of fifty pounds of Tobo. for A Non Suite as alsoe ye Sume of one hundred Eighty & Six pounds of Tobo.

Comand was given to ye Sherf. of Kent County ye 25. day of June Annoq Domini 1700 that he Take
John Hollinsworth Admr. of all & Singular ye goods Chattles & creditts of John Hollinsworth late of Kent
County Decd. if he should be found in his bailiwick and him Safe Keep Soe that he have his body before his
his majties Justices at ye next Court to Answer unto Robert Gouldesborough of A plea that he render
him ye Sume of Six hundred pounds of good Tobo. &a
Att which next Court Vizt. the 27. day of Augt. Anno Domi 1700 ye day of ye returne of Said
writt came Elias King high Sherf. of Said County & made returne thereof in these words Vizt.

On which Said Day came ye Said Defendant by Michael Earle his Attry & prayes thereof to impar[le]
untill ye next Court which was granted unto him & Same day was given ye plaint likewise
The which cause being Cont. from Court to Court untill this prSent Court And now here at this
day Vizt. ye 28. day of Novemr. Anno Domi. 1700 came as well [ye sd Pl]aint. by Richard
Macklin his Attry as alsoe ye Said Defendt. by his Said Attry & ye Said [Cause stan]ding for Tryall [ye]
plaintiff Decls. Vizt.
Kent Ss    John Hollinsworth Admr. of all & Singular ye goods chattles and Cr[edits of] John Hollinsworth

   late of Kent County Decd. was Sumoned to Answer unto Robert Gouldesborough of A plea that

   he render him ye Sume of Six hundred pounds of good Tobo. which from him he Unjustly

   Dataines
And whereupon ye Said Robert by Richard Macklin his Attry Sayes that whereas ye Said John
decd. in his lifetime Att Talbott County within ye jurisdiction of this Court in ye Month of janry Ann[o]
