526) Wright & C.o" some or one of them to the said respective persons creditors of the said Partnership of West & Hobson by the express order or direction of the aforesaid Stephen West and John Hobson one of them And these Deponents do for themselves further say that the said Debt or any part thereof is not satisfied or is there anything to come to the credit of the said Debtors or either of them saving what they are credited for except any thing hath been received in America for and on behalf of the said Creditors which is unknown to these deponents and that there are not any other accounts between the said Creditors and the said Debitors or either of them to the value of the said Debt or any part thereof for any matter or thing accrued since the commencement of the said account The Deponent John Hilton giving for reason of his knowledge in the premises that he hath lived with the said Mauduit Wright & C.o and Israel & William Mauduit kept their Books of Account and been conversant in their affairs in Business and Trade for the Term and space of sixteen Years last past and upwards And the Deponent William Mauduit for himself saith that he hath not given or have or hath the before named Israel Mauduit Thomas Wright and John Phillibrown any or either of them (to the best of this deponents knowledge and belief) given the said Debtors or either of them any release or discharge from the said Debt or any part thereof And the Deponent John Hilton for himself further saith that he was present and did see Israel Mauduit Will.m Mauduit and John Phillibrown (by the several names Stiles and titles of Israel Mauduit William Mauduit and John Phillibrown of London Merchants surviving partners of Thomas Wright late of London Merchant Deceased) severally sign seal and as their several act and Deed in due form of Law Execute and deliver the original paper writing or letter of Attorney Marked with the Letter A. hereunto annexed bearing date this third day of October to and for the uses intents and purposes therein mentioned and that in Testimony of such executed he this deponent and John Hattam severally set signed or subscribed their names as Witnesses thereto as thereby may appear Both Sworn the third day of Will Mauduit October in the Year 1785 Before me John Hilton R Clark Mayor I Benjamin Hammatt Notary Public dwelling in London duly admitted and sworn do hereby certify and attest that the Right Honourable Richard Clarke Esquire before whom the aforegoing affidavit was this day sworn and by him signed (in presence of one Notary) (is) |
