518 for himself his Executors Administrators and Assigns doth further covenant to and with the said William Adams his Heirs Executors Administrators and Assigns that he the said Thomas Brook Hodgkin his Executors ^Administrators^ or Assigns shall and will with all convenient speed repair and put in order in a neat and decent manner (at his own proper cost and charge) the Rooms of the said Dwelling House which at present are impa^i^red and also repair the Doors and windows of the said House so far as may be reasonably needfull and shall erect or cause to be erected at his own cost sufficient enclosure (in the usual form) of Post and rail Fencing to inclose the said Two Acres of Ground and shall also erect on the same Lot where the dwelling house aforesaid stands a pump of Water (if the same can be obtained) and shall also build a meathouse a Wooden Stable and a room for a carriage and enclose sufficient ground for a Garden convenient to the said Dwelling House and the said William Adams for himself his Heirs Executors Administrators and Assigns and every of them doth covenant promise contract and agree to and with the said Thomas Brooke Hodgkin his heirs Executors Administrators and Assigns and every of them by these presents for and under the yearly Rents covenants and conditions herein before expressed on the part and behalf of the said Thomas Brooke Hodgkin his Executors Administrators and Assigns to be kept and performed as aforesaid shall and may peaceably and quietly have hold use occupy and enjoy the aforesaid two Lots of ground and the Building or dwelling House thereon erected for and during the Term aforesaid without any Let trouble hindrance or interuption of him the said William Adams his Heirs Executors Administrators or Assigns or any other person or persons claiming or that shall or may claim under him or them or either of them Provided Always and it is the true intent and meaning of these presents that if the said Dwelling House shall be accident of fire or any other unavoidable casualty be destroyed during the Term aforesaid then and in such case this Indenture of Lease In Testimony whereof the parties to these presents have hereunto interchangably set their hands and affixed their Seals the day and Year Signed Sealed and Delivered in presence of (it is agreed by the parties above mentioned that the said W.m Adams (seal) Thomas Brooke Hodgkin his Executors or Assigns shall pay at known cost the public assessment on the above Lots and Houses Tho.s B Hodgkin (seal) (during the Term aforesaid) and the said Thomas Brooke Hodgkin his Executors Administrators and Assigns shall at his and their own cost keep the said Dwelling House in necessary repair during the said Term Maryland On the 28.th day of February 1786 William Adams appeared before the Subscriber one of the Judges of the General Court and Acknowledged the within Instrument of writing to be his Act and Deed for the use intent and purpose therein mentioned according to the Act of Assembly in such case made and provided Recorded February the 28.th 1786 A C Hanson |
