479 as partners as aforesaid and to either of us individually and to us the said John Cookson and Lewis Lambert Individually from any person or persons whomsoever in any Province or part of North America or any account whatsoever and on receipt thereof good and sufficient Releases Acquitances and discharges to make and give for the same and for us and in our names Collectively and Individually as aforesaid to settle all accounts whatsoever which now are or at any time or times hereafter shall or may be depending and unsettled between us and any or either of us as partners or seperately and Individually as aforesaid and any person or persons whomsoever resident in America as aforesaid and also for us and in our names to compromize and Compound any Debts or Debt which now are or is at time or times hereafter shall or may be due or owing to us or any or either of us as Partners and Individually as aforesaid from any person or persons whomsoever resident as aforesaid by accepting Less than the amount thereof and to accept of such composition or compositions in full discharge or satisfaction of or for any such Debt or Debts as he the said John Paddington shall in his discretion think proper and in such last mentioned case and upon receipt of such composition or compositions good and sufficient acquitances Releases and discharges to make and give for the whole of such Debt or Debts in satisfaction whereof such composition shall be received and taken And further We the said James Wellington and Company Samuel Brandram Thomas Templeman Richard Jaques Robert Dimsdale Charles Turner John Cookson Joseph Fawcett John Cookson and Lewis Lambert for ourselves and each of us as Partners and Individually as aforesaid do hereby authorize and impower the said John Waddington to make and substitue an attorney or attorneys as occasion shall require and as he shall think necessary and to make and allow to such attorney or attorneys such recompence or satisfaction as he shall the said John Waddington shall think proper and reasonable And Generally for us and in our Names in such Capacities as aforesaid to do execute and perform as well personally as by substitution all other Acts and Deed Matters and things whatsoever as he shall deem to be requisite and necessary for effectuating the purposes aforesaid or in any wise Relating thereto as fully and effectually to all intents and purposes whatsoever as he the said James Wellington and Company Samuel Brandram Thomas Templeman Richard Jaques Robert Dimsdale Charles Turner John Cookson Joseph Fawcett John Cookson and Lewis Lambert might or could do if personally present And we do hereby severally Ratify allow and confirm all and whatsoever the said John Waddington or any attorney or attorneys und^er^ him shall Lawfully Do or cause to be done in or about the premises by virtue of these presents In Witness whereof the said Several parties ^to^ these presents have hereunto set their hands and Seals this sixth day of September in the year of our Lord one thousand seven hundred and eighty five Sealed and Delivered James Wellington for self & C.o (seal) (being first duly stamped) in the presence of Sam.l Burnham for self & C.o (seal) Tho.s Scatchard N.o 66 Watling street Rob.t Dimsdale for self & C.o (seal) James Wellington attorney for Tho.s Hervey Clerk to Cookson & Fawcett (seal) M.r Seatchard James Cookson (seal) Lewis Lambert (seal) |
