436) Ex.d & Del.d This Indenture made this fourteenth day of September in the year of our Lord one thousand seven hundred and eighty five Between Clement Hollyday and Gabriel Duvall Esq.rs Commissioners to preserve Confiscated British property of the one part and Baker Johnson of Frederick County of the other Part Whereas at a Public sale amongst others of the Land herein after discribed and mentioned to be conveyed had at Frederick Town in Frederick County aforesaid on the tenth day of October Seventeen hundred and Eighty one by Virtue of and in pursuance of an act of assembly "for the omission of Bills of Credit not exceeding two hundred thousand pounds on the security of double the value in Lands to defray the expences of the present campaign he the said Baker Johnson was the best and highest Bidder of or the Lot piece or parcel of Land herein after described and mentioned to be conveyed at and for the price of Three thousand three hundred and fifty pounds for which he gave his Bond with security agreeable to the said Act and hath since fully paid and satisfied to the Treasurer of the western Shore the said purchase Money together with all Interest due thereon Now This Indenture Witnesseth that the said Clement Hollyday and Gabriel Duvall Commissioners aforesaid by for and in consideration of the said payment and other the premises and by virtue of any and all act or acts ^of assembly^ in such case made and provided Have granted Bargained sold conveyed and released and by these presents Do grant Bargain sell convey and release to the said Baker Johnson his heirs and assign all that the said Lot piece or parcel of Land being part of Taskers chance lying in the said County distinguished by the Number twenty six Beginning at a bounded beach Tree it being the beginning Tree of Taskers Chance and running thence with the said Land North eighty degrees West Thirty seven perches South fifty five degrees west fifty two perches South sixteen degrees West eight Perches South seventy five degrees west sixty six Perches South forty five degrees West thirty four perches and one half of an Perch to the third Line of Laurence Prangles Land then with the said Land allowing four Degrees Variation North thirty four Degrees West forty six perches to the end of the said Third Line still with the said Land North Nine degrees East eighty perches to the end of the fourth Line of Christian Thomas's Land then with the said Land reversed allowing four Degrees Variation North forty five and an half Degrees East one hundred and sixty two perches to Monococy then by and with Monococy South sixth Nine degrees East sixty Perches South fifty five degrees East thirty eight perches South twenty nine degrees East twelve Perches South eighteen degrees West sixty two perches then by a straight Line to the Beginning containing one hundred and Seventy Eight acres and one half of an Acre of Land more or Less with the appurtenances To have and To hold the said Lot piece or parcel of Land with its rights members and appurtenances to him the said Baker Johnson his heirs and assigns to the only proper use and behoof of him the said Baker Johnson his heirs and assigns for ever and to or for no other use intent or purpose whatsoever warranted and defended to him the said Baker Johnson his heirs and assigns agreeable to all or any acts or act of assembly in such case made and provided (In) |
