395 Sale of Certain British property pledged for the Redemption of Certificates and an act entitled an act to post pone the Sale of Certain Confiscated British property for the Redemption of Certificates and other the Acts of the General Assembly concerning the premises proceed to the Sale of Monococy Manor in Frederick County at which said Sale a Certain William Smallwood purchased for the aforesaid James Craik and Thomas Marshall Lot Number fifty eight being part of said Manor for the Sum of twelve hundred and sixty five pounds in Army Certificates he being the highest bidder therefor at and for the Sum aforesaid Now this Indenture Witnesseth that the said Clement Hollyday and Gabriel Duvall for and in Consideration of the aforesaid Sum of twelve hundred and sixty five pounds in Certificates aforesaid with the Interest due thereon to the first day of April last to them in hand paid by the said James Craik and Thomas Marshall the receipt whereof is hereby acknowledged Have granted bargained & sold released and confirmed and by these presents Do grant bargain & sell release & Confirm unto them the said James Craik and Thomas Marshall their Heirs and Assigns for Ever All the aforesaid Lott Number fifty eight being part of Monococy Manor aforesaid in Frederick County aforesaid begining for the outlines thereof at a bounded white oak Tree standing on the south side of Israels Creek at the foot of a hill it being the original begining Tree and runing thence North seventy two Degrees west one hundred and twenty perches then North twenty Degrees East one hundred & eighty perches then South seventy five Degrees East one hundred and sixty nine perches then South seventeen Degrees west one hundred and eighty six perches then by a straight Line to the begining containing one hundred and ninety eight acres together with all and singular the Improvements Advantages Hereditaments and Appurtenances to the same Lott of Land belonging or in any wise Appertaining and the Reversion and Reversions Remainder and remainders Rents Issues and profits thereof and every part and parcel thereof and also all the Estate Right Title Interest claim and demand whatsoever of them the said Clement Hollyday and Gabriel Duvall as Commissioners aforesaid both at Law and in Equity of in and to the said Lot of Land and premises and every part thereof To Have and To Hold the aforesaid Lot of Land containing one hundred and ninety eight acres with all and singular the Premisses and appurtenances unto them the aforesaid James Craik and Thomas Marshall their Heirs and Assigns to the only proper use and behoof of them the said James Craik and Thomas Marshall their Heirs and Assigns for Ever as Tenants in Common and not as Joint Tenants In Witness whereof the said Clement Hollyday and Gabriel Duvall have hereunto Set their Hands and Affixed their Seals the day & year first above Written Signed Sealed & delivered Clement Hollyday (Seal) in presence of G Duvall (Seal) W.m Hall 3.d |
