390) According to Law hath become possessed of and entitled unto And Whereas also the said David Stewart is seized in Fee Simple in his own right of an undivided Moiety and half part of one other Lott or Parcell of Ground Situate and lying in Baltimore Town aforesaid being part of Lott Number Ten and contained within the following Metes and Bounds Courses and Distances to wit Beginning for the same on the North side of an alley called Rogers's Ally laid out by a Certain Benjamin Rogers thro the said Lott and runing thence west parallel with Baltimore Street twenty five feet thence North parallel with Church Alley Seventy five feet thence East twenty five feet and thence South parallel with Calvert Street Seventy five feet to the Beginning And Whereas the said David Plunket is also possessed of and lawfully intitled in his own Right to the other undivided Moiety and half part of the said Lotts Numbered Eighty seven Eighty eight and Eighty Nine in such manner and forms as is above recited and set forth and subject to the same terms Conditions and Advantages as the said David Stewart enjoys and holds the other undivided Moiety and half part of the said Lotts And Whereas also the said David Plunkett is seized in Fee Simple of the other undivided Moiety and half part of the above described Lott and Parcell of Ground Situate in Baltimore Town aforesaid being part of Lott Number Ten as described on the Original Platt of Baltimore Town And Whereas the said David Stewart and David Plunkett being desirous to obtain a Loan of Money not only on their own personal Credit but also have proposed to the said Robert Daniel Crommelin and Gulian Crommelin that they the said David Stewart and David Plunkett would secure the punctual repayment of any Sum or sums of Money which they the said Daniel Crommelin and Sons should advance the said Stewart and Plunkett together with the Stipulated Interest payable annually by Mortgaging the above described Tracts and Parcels of Land Lotts and parcels of Ground together with all the Buildings and Improvements thereon as a further Security for the said Loan And Whereas the said Daniel Crommelin and Sons have agreed at the special Instance and request of the said Stewart and Plunkett to lend and advance to the said Stewart and Plunkett the Sum of forty four thousand Guilders Current Money of the States of Holland for the term of Two years at the rate of five per Cent Interest thereon payable annually to the said Daniel Crommelin and Sons in Amsterdam aforesaid on the aforesaid proposals of Securing the punctual repayment of the principal Sum and Interest thereon at the time stipulated therefor ^by^ Mortgaging the Lands Lotts of Ground Premises and appurtenances above enumerated and for that purpose these presents are executed Now this Indenture Witnesseth that the said David Stewart in his own Name and the said David Plunkett by the said David Stewart his Attorney for this purpose specially appointed as by the Powers hereto annexed will appear for and in Consideration of the ^said^ sum of Forty four thousand Gilders to them in hand secured to be paid by the said Robert Daniel Crommelin and Gulian Crommelin the Receipt whereof is hereby acknowledged and themselves to be fully satisfied and paid therewith Have granted bargained Sold assigned transferred released aliened Enfeoffed and Confirmed and by these presents Do and each of them Doth grant bargain sell assign transfer alien Enfeoff and Confirm unto the said Robert Daniel Crommelin and Gulian Crommelin their Heirs and Assigns All the Tracts parts of Tracts and Parcels of Land above Named and particularly described and all the Lotts and parts of Lotts Situated in Baltimore Town and Numbered and described |
