248 Chattels Merchandizes Effects Deeds Instruments Books Papers Writings things Debts Dues and Demands whatsoever which now is or are or shall or may be or become due owing and payable or belonging to him from such person and Persons Respectively upon any Account or accounts or by any ways or means Whatever and upon nonpayment or Non Delivery thereof respectively for him and in his name or otherwise as to his said Attorney shall seem meet to his Use and at his proper Costs and Charges to sue implead and prosecute all and every person and persons whom it may Concern in any Court or Courts of Law or Equity or elsewhere or otherwise how^so^ever for the recovery of such sum and sums of Money Goods Chattels Merchandizes and Effects Deeds Instruments Bookes Papers Writings Things Debts dues and Demands whatsoever or any of them by such Legal ways and means and in such Manner and form as his said Attorney shall be advised and in his Discrestion shall think meet and expedient and most Conducive to his Interest and Advantage and for him and in his name and at his proper Costs and Charges to maintain proceed in and Carry on such suit and suits which shall be so instituted to Judgement to Judgement Sequestration and Execution or untill full and Sufficient Satisfaction shall be had and obtained therein and also to appear for him to any suit or Suits at Law or in Equity or otherwise which shall be brought commenced and Prosecuted against him and and to Defend and Plead thereto or suffer Judgement to be had against him therein or in any of them and otherwise to Act therein as his said Attorney in his Discretion shall think fit and Likewise to compound settle and adjust all and every such suit and suits as well those that shall or may be instituted on his Behalf as such as may be brought against him upon such Terms and Conditions and to accede and agree to such abatement Deductions and allowances to be made thereout or out of any of them and to such other stipulations articles matters and things touching or concerning the same as he the said Attorney shall think fit just and reasonable on his Part And if occasion be to refer and submit the same or any of them or any other Dispute or Differences which may arise on his Behalf with any Person or Persons touching any matter or thing whatsoever to Arbitration in such manner and under such Terms and Conditions as he shall think Proper and for him the said James Gildart to execute seal and deliver in due form of Law proper and sufficient Bond or Bonds of Arbitration for that Purpose and to abide and fulfill on his Part the Award or Awards which shall be ^made^ by Virtue thereof And to obey and submit to any rule or rules of any Court or Courts of Law or Equity touching or Concerning any such suit or suits and to acknowledge satisfaction upon record for any sum or sums of money recovered or Awarded to him thereon and to pay and satisfy such Damages and Costs as he may be Adjudged and Condemned to pay and to do Transact and execute all such other matters and Things therein as shall be incumbent on him to do and most consistent with his Interest to the best of His Judgment and also upon receipt of any sum or sums of Money Debts or Demands goods Merchandizes or Effects Due owing and payable or belonging to him from any Person or Persons for him and in his name to give Seal and execute full and sufficient releases Acquitances and Discharges for the same to the good likeing and approbation of the Parties and also to pay and satisfy all Just and Legal Debts due or to grow Due and payable from him to any other Person or Persons if any such shall be demanded taking proper receipts or Discharges for the same and likewise for him to Adjust ballance or (Liquidate) |
