242 Ex.d & dl.d This Indenture made this fourth Day of October one thousand seven hundred and Eighty four Between John Dorsey of Baltimore Town Merchant of the one Part and Thomas Dorsey of Ann Arundel County Gentleman of other Part Witnesseth a Partnership in Trade and Commerce was heretofore established Between Samuel Chase and John Dorsey & Thomas Dorsey and afterwards another of the same Nature was established between Luke Wheeler John Dorsey Thomas Dorsey and Samuel Chase And Whereas upon Closeing the said Partnerships it appears that the said Samuel Chase John Dorsey is individually indebted to the said Partnerships and whereas the said Thomas Dorsey has been Oblidged to pay out of his own Private fortune several Debts and Claims against the said Partnerships and has bee Obliged to Mortgage his Property as a security for Payment of other Claims and Demands upon the said Partnerships the satisfaction and Payment of which Debts Claims and Demands is greatly beyond his Proportion of the Debts of the said Partnerships and Whereas the said John Dorsey is Willing and Desirous to pay what he owes individually to the said Partnerships and to the said Thomas Dorsey in his Private right and also to indemnifie the said Thomas Dorsey and to pay and satisfy as far as his property will go his proportion of the Debt and Claims upon the said partnerships Now this Indenture Witnesseth that the said John Dorsey for the Purposes aforesaid and for and in Consideration of the sum of five Shillings Current Money to him in hand paid by the said Thomas Dorsey the Receipt whereof he doth hereby Acknowledged hath bargained and sold & by these Presents Doth Bargain and sell to the said Thomas Dorsey and his Heirs all that part of a Tract or Parcell of Land of which he is Siezed in Baltimore County Called Eppington Forrest Containing eight hundred Acres More or less and also all the Lands Effects goods and Chattels and all and singular other the Premises Bargained and sold in and by the several Mortgage contained specified by the Schedule hereunto Annexed and the Reversion and Reversions Remainder and Remainders in all the Lands Bargained and sold as Aforesaid and also all the Estate right title and Property Claim or Demand Whatsoever in Law or Equity of the said John Dorsey in or to the said Lands Effects goods Chattels and Premisses or any Part thereof to have and to Hold the same to him the said Thomas Dorsey and his Heirs to the only use and behoof of the said Thomas Dorsey and his Heirs and to and for no other Use intent or purpose Whatsoever And this Indenture further Witnesseth that the said John Dorsey for the mere Effectually securing the Payment and satisfaction of the Debt or Debts aforesaid hath Bargained and Sold Granted Assigned and sett over and by these Presents doth hereby Bargain and sell grant Assign and sett over to the said Thomas Dorsey and his Heirs all his right and Estate in all those Tracts or Parcels of Land in Virginia which he held as tenant Common with the said Samuel Chase and a certain Jacob Myers Also all his right and Estate in all those Lands in Virginia which he holds in Common with the said Thomas Dorsey and Samuel Chase also all his right and Estate in all those Lands in Virginia which he holds in his private right also all his Town which he also holds in common with the said Thomas Dorsey and Samuel Chase also all his right and Estate in the eighteen Acres of Land and three Quarters of an Acre Purchased from Jese Hollingsworth being part of Timber Nute Also all his right and Estate in those lands and forge which the said John Dorsey lately Purchased of the Commissioners being the late Property of Paussell and Company also all his right and Estate in the Lands and Furnace Purchased by Charles Ridgely & C.o from Elam Bailey and Samuel Norwood also all his Right and Estate of the Lands Purchased by the said Charles Ridgely & C.o of the said Commissioners for the sale of Brittish Property for the use of the said Furnace and Forge also all his right and Estate in the Negroes and Stock of the said Furnace and Forge & Profits heretofore or hereafter to be made Also all his right and |
