191 Ex.d & dl.d This Indenture made the twentieth day of October Anno Domini one thousand seven hundred and eight three Between Morgane Jones of the County of Ann Arundell and State of Maryland of the one part and David Weems of the County and State aforesaid of the other part Witnesseth that the said Morgane Jones for and in Consideration of the sum of three thousand seven hundred and fifty pounds continentall Currency to him in hand paid by the said David Weems the receipt whereof he the said Morgane Jones doth hereby acknowledge and thereof & every part part thereof doth for himself his heirs Executors Administrators or Assigns hereby clearly and absolutely exonerate acquitt and discharge the said David Weems his heirs Executors Administrators or Assigns for ever Hath given granted bargained and sold aliened ratifyd confirmed and made over and in order to make unto the said David Weems a clear and indisputable right and title to a Tract or Tracts of Land which I baught of John Ross laying between the Northwest and Northeast folk Nanticoke in Dorchester County Maryland containing agreeable to said John Ross's deed to me for two hundred and forety nine Acres of land together with all and singular the houses outhouses edeffices buildings fences woods timber and timber Trees Orchards Gardens profits comodities cultivations and improvements & appurtenances of what nature or kind soever to them or either of them in any wise appertaining or belonging and the reversion & reversions remainder & remainders of all and singular the premises together with all deeds patents evidences Escripts & writings whatsoever tuching or concerning the premises or any part thereof above mentioned To have & to hold the said Tracts or parcells of land afforesaid with the premises & appurtenances above mentioned and granted & every part and parsell thereof unto him the said David Weems his heirs and Assigns forever and to the only proper use and behooff of him the said David Weems his heirs for evermore and to no other use intent & purpose whatsoever And the said Morgane Jones for himself his heirs Executors Administrators or Assigns covenants and agrees to and with the said David Weems his heirs Executors Administrators or Assigns that the barganed premises & appertanances & every part and member of the same are at the time of the sealing and delivery of these presents clear & free from all & all manner of former bargains sales Joyntures Dowers title of dower entails estates Statutes Judgments or other Incumbrances whatsoever and allso that the said Morgane Jones and his heirs &Co and every of them the land premises and appurtanances as aforesaid and every part thereof as above mentioned to be bargained and sold against him the said Morgane Jones his heirs &Co as from any person or persons clameing or to claim any estate right or title or Interest under him the said Morgane Jones And lastly that the said Morgane Jones his heirs as aforesaid at any time hereafter when thereunto required so it be at the proper cost and charge in Law of the said David Weems his heirs or Assigns shall make do acknowledge execute and suffer all such reasonable acts & things devices and assurances ^whatsoever^ in law for the better establishing and sure makeing of the premisses and appurtenances aforesaid to the said David Weems his heirs &Co for ever according to the true intent and meaning of these presents In witness whereof the party first above mentioned to these present Indenture hath sett his hand and Seal the day and year above written Signed Sealed & delivered in the presents of Morgan Jones (Seal) Richard Harrison Tho.s Tongue |
