166 This Indenture made this twenty Eight day of July in the Year of Our Lord One thousand seven hundred and Eighty three Between Thomas Bond of Harford County Junior and Catharine his Wife of the One Part and William Fell of Fells Point in Baltimore County of the Other Part Whereas a Certain Edward Fell late of Lancaster in England who was Seized and possessed of Sundry Tracts of land in Maryland did make the will in writing duly Executed According to Law And Amongst other things did Devise and Bequeath all his Lands and Tenements in Maryland to the Younger Children of his Brother William Fell then of Maryland but since Deceased in Fee; And Whereas the said Catharine who is now intermarried with the said Thomas Bond was the Youngest Daughter of the said William Fell And is now the Only Surviving Issue of the said William Fell Deceased; Now this Indenture Witnesseth That the said Thomas Bond and Catharine his Wife for and in Consideration of the Sum of Fifteen hundred pounds Current Money to them in Hand paid before the ensealing and Delivery of these presents the receipt whereof is hereby Acknowledged do Release Exonerate & Acquit the said William Fell his Heirs Executors Administrators and Assigns have Granted Bargained Sold released and Confirmed And by these presents Do grant Bargain Sell release and Confirm Unto the said William Fell his Heirs and Assigns all those following Plantations Farms and Tracts of Land Situate lying and being in the State of Maryland That is to say the Tract of Land called Fells Dale near Westminster in Baltimore and Fredrick Counties The Tract of Land called Co^o^mbs Adventure near the Ferry Branch in Baltimore County; The Tract of Land called Swathmore in Harford County and all and Singular the Lands and Tenements formerly the province but now the State of Maryland aforesaid which were Devised and bequeathed by the said Edward Fell late of Lancaster in England to the Younger Children of the aforesaid William Fell deceased late of the province but now of the State of Maryland now in the Actual Possession of the said William Fell the party to these presents by Virtue of a Bargain and Sale to him thereof Made by the said Thomas Bond and Catharine his Wife the day next before the date of these presents And by Singular the Houses Out Houses Buildings Woods Meadows Orchards Ways Easements Emoluments and the reversions Remainders Rents Issues and Profits to the same belonging or in any wise Appurtaining to the same or any part thereof And also all Deeds Patents Evidences and Writeings touching and Concerning the same to him the said William Fell his Heirs and Assigns To have and to hold all and Singular the above discribed Lands and Premisses with their and every of their Appurtenances Hereditaments and Tenements in these presents Released and Confirmed to the said William Fell his Heirs and Assigns for ever |
