684 nine Degrees West six Perches thence North eighty nine degrees and a quarter West twenty one Perches thence North eighty four degrees and a half West Twenty eight Perches to the Bridge crossing the said Run thence North Twenty degrees West twenty two perches and a half to intersect the West by North Line of the said Land thence with the said West by North Line Twenty five perches thence South by West One hundred and seventy Perches thence East by South two hundred and fifty seven Perches thence with a streight Line to the Begining containing and laid out for Two hundred and fifty Acres of Land more or less together with all Houses Outhouses Buildings Fences Woods Underwoods Trees Timber Trees Ways Easements Profits Benefits and Appurtenances whatsoever unto the same being or any part or parcel thereof belonging or in any wise appertaining To have and to hold the aforesaid two hundred and fifty Acres of Land and Premisses with all and every of the Appurtenances unto the said Thomas Harwood jun.r his Heirs and Assigns for Ever to the only proper use and behoof of him the said Thomas Harwood jun.r his Heirs and Assigns for Ever and to no other use intent or purpose whatsoever free and clear and freely and clearly acquitted exonerated and discharged of and from all manner of Incumbrances whatsoever The Rents and Services becoming due to the Chief Lord or Lords of the Fee or Fees thereof only excepted and foreprized And also that He ^the^ said Richard Beard his Heirs Executors and Administrators and every of them all and singular the above bargained Land and Premisses with all and every of their Appurtenances unto the said Thomas Harwood jun.r his Heirs and Assigns against all Persons whatsoever claiming from by or under him them or any of them shall will Warrant and for ever hereafter defend by these Presents And for the better confirming and assuring unto the said Thomas Harwood jun.r and his Heirs the Lands and premisses aforesaid with all and singular the Appurtenances it is hereby covenanted and agreed between the said parties to these presents that a Common Recovery of the said Land and Premisses with the Appurtenances shall and may be had suffered and perfected at the next Provincial Court in which said Common Recovery it is hereby agreed that Thomas Jenings of the City of Annapolis shall be Demandant and the said Thomas Harwood jun.r Tenant and the said Richard Beard shall be Vouchee and he shall vouch over the Common Vouchee after the manner and Course of a common Recovery for assurance of Lands And it is hereby further covenanted concluded declared and fully agreed between the parties to these and the said Thomas Jenings hath testified his Assent thereto by signing and sealing the same that the said Common Recovery shall enure and be and shall be construed deemed and taken to enure and to be ^the^ use and Behoof of the said Thomas Harwood jun.r his Heirs and Assigns In Witness whereof the said Richard Beard hath to this present Indenture set his Hand and Seal the Day and Year above Written Signed Sealed and Delivered Rich.d Beard (LS) In Presence of Th Harwood j.r (LS) Philip Thomas Lee Tho.s Jenings (LS) On the back of the aforegoing Deed was thus Endorsed (to wit) Received the Day and Year within mentioned of and from the within named Thomas Harwood j.r the within Sum of one ^five^ shillings Sterling money of great Britain it being the consideration within mentioned Rich.d Beard Philip Thomas Lee On |
