48 Large appear which said several Parcels of Land hereby released or mentioned or intended so to be now are or late were in the Tenure and Occupation of them the said Richard Bishop and Mary his Wife And all Edifices & Buildings Waters Water Courses Easements Profits Commodities Advantages Improvements and Appurtenances whatsoever to the said Parcels of Land hereby released or mentioned or intended so to be or to any of them belonging or in any wise Appurtaining or to or with the said Parcels of Land or any of them had used Occupied or enjoyed and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits of the said Lands and Premises And all the Estate Right Title Interest use Trust property claim and Demand whatsoever both at Law and in Equity of them the said Richard Bishop and Mary his wife or either of them of in or to the said Lands Tenements & Premises or any of them To have and to Hold the said Several Parcels of Land and Premises hereby granted and released or mentioned or intended so to be with their and every of their Appurtenances unto the said Elijah Bishop his Heirs and Assigns to and for the use and behoof of him the said Elijah Bishop his Heirs and Assigns for ever to the Intent and Purpose that the said Elijah Bishop may be perfect Tenant of the Freehold of the said Premises that a common Recovery may be had and suffered against him in such Manner as is herein after mentioned And for that Purpose it is hereby covenanted and Agreed by and between all the Parties to these Presents that before the end of this Presents September Provincial Term or some ^other^ ensuing Term at the Cost and Charges of the said Richard Bishop one or more Writ or Writs of Entry sur Disseisin en le post shall and by be brought commenced and Prosecuted out of his Lordships High Court of Chancery returnable and to be returned before his Lordships Justices of the Provincial Court in the name of the said Stephen Bordley Junior as Plaintiff or Demandant against the said Elijah Bishop whereby the said Stephen Bordley Junior shall Demand against the said Elijah Bishop the Lands and Premises herein before granted and released or mentioned or intended so to be with their and every of their Appurtenances by such apt and convenient Names and Descriptions as shall be thought proper to ascertain the same to which Writ the said Elijah Bishop shall Appear Gratis in his proper person or by his Attorney or Attornies lawfully authorized and shall Vouch to Warrant the same Premises the said Richard Bishop and Mary his wife who shall appear gratis in their own proper Persons or by their Attorney or Attornies lawfully Authorized and enter into the said Warranty and vouch over to warrant the same Premises the Common Vouchee of the same Court who shall thereupon appear and enter into the said Warranty and after Imparlance make Default and Depart in Contempt of the Court so that one or more common Recovery or Recoverys shall and may be had & suffered of the said Premises with the proper Judgments to be thereupon given & Execution awarded according to the Course of common Recovery's for the Assurance (of) |
