462 and Description as shall be proper in that behalf to which writ the said Charles Carroll shall appear gratis in his own proper person or by his Attorney or Attornies lawfully authorised and shall and will vouch or call to warrant the same premises the said Oliver Cromwell who shall also appear gratis in his own proper person or by his Attorney or Attornies lawfully authorised and shall and will enter into the said warranty and vouch over to warrant the same premises the Common Vouchee who shall thereupon appear and enter into the said warranty and after Imparlance make default and such further and other proceedings be had upon the said writ and all the said parties shall so demean themselves therein that one good and perfect Common Recovery with double voucher shall or may be had suffered perfected and executed of for or upon the premises with their appurtenances in all Things according to the usual Course order and Form of Common Recoveries with double voucher for assurance of Lands in such Cases used And it is further Covenanted concluded declared and fully agreed by and between all the said parties to these presents for themselves and their Heirs and it is their true Intent and Meaning that the said Common Recovery so as aforesaid or in any other Manner to be had suffered and executed of for or upon the said premises or any part thereof and the full Force and Effect and Execution thereof and also all and every other Common Recovery or Recoveries to be had levied suffered or executed of for or upon the premises or any part thereof to which the said parties to these presents or any of them shall be parties or party a privy shall be enure and shall be construed expounded deemed and taken to be and enure to the Use and Behoof of the aforesaid Charles Carroll his Heirs and Assigns for ever In Trust nevertheless as to one undivided fifth part of the said Land with its appurtenances for Charles Carroll Esq.r Barrister his Heirs and Assigns for ever as to one other undivided fifth part thereof in Trust for Daniel Dulany Esq.r his Heirs and Assigns for ever As to one other undivided fifth part thereof In Trust for Daniel Carroll the Eldest son of Charles Carroll late of Duddington deceased his Heirs and Assigns for ever as to one undivided tenth part thereof in Trust for Walter Dulany Esq.r his Heirs and Assigns for ever as to one other undivided Tenth part thereof in Trust for Daniel Dulany the Son of the said Daniel Dulany Esquire his Heirs and Assigns for ever and as to the remaining undivided fifth part thereof to the only proper Use and Behoof of the aforesaid Charles Carroll party hereto his Heirs and Assigns for ever and to or for no other use Intent or purpose whatsoever And the aforesaid Oliver Cromwell for himself his Heirs Exors and Admors doth hereby covenant and grant to and with the aforesaid Charles Carroll party hereto His Heirs Exors Admors and Assigns that he the said Oliver Cromwell and his Heirs will warrant the said Land with its appurtenances to the same Charles and his Heirs against the aforesaid Oliver and his Heirs and all person and persons claiming or to claim the same by from or under him them or any of them And further that he the said Oliver Cromwell and his Heirs shall and will at any time hereafter at the reasonable Request Costs and Charges in the Law of the aforesaid Charles Carroll party hereto his Heirs or Assigns make do suffer acknowledge or execute all or any such reasonable (act) |
