461 X.d This Indenture Tripartite made the eleventh day of April in the year of our Lord One thousand seven hundred and seventy three Between Oliver Cromwell of Baltimore County of the first part Charles Carroll Esquire of Carrollton of the second part and Thomas Johnson Junior of the City of Annapolis of the third part Witnesseth that the said Oliver Cromwell for and in Consideration of the sum of three hundred and thirty pounds twelve shillings and six pence Current Money to him in hand paid at or before the sealing and Delivery of these presents the receipt whereof he doth hereby acknowledge and thereof and therefrom and of and from every part and parcell thereof doth hereby release acquit and discharge the aforesaid Charles Carroll his Heirs Exors Admors and Assigns and every of them and for the docking barring and extinguishing all Estates Tail and all Revertions and Remainders thereupon expectant or depending of or in the Land and appurtenances herein aftermentioned and for settling and assuring the same in such manner as is herein after declared Hath granted bargained sold aliened released enfeoffed and confirmed And by these presents Doth grant bargain sell alien release enfeoff and confirm unto the said Charles Carroll his Heirs and Assigns for ever All that Tract or parcel of Land called Kensey lying and being in Ann Arundel County aforesaid originally granted for four hundred acres except such part or parts thereof as is or are included within elder Grants or patents Together with all Houses Buildings Gardens Orchards Woods Under Woods waters water Courses ways priviledges Improvements advantages and appurtenances whatsoever to the same belonging or in any wise appertaining And the Revertion and Revertions Remainder and Remainders Rents Issues and profits thereof and of every part and parcel thereof And all the Estate Right Title Interest Use Trust property Claim and demand whatsoever of him the said Oliver Cromwell of in or to the same and every part thereof To have and to hold the said tract or parcel of Land (except as before excepted) and premises with its Rights Members and appurtenances to the aforesaid Charles Carroll his Heirs and Assigns for ever to the use and behoof of him the said Charles Carroll his Heirs and Assigns for ever Yet nevertheless to the Intent and purpose that by virtue of these presents he the said Charles Carroll may be and become a good and perfect Tenant of the Freehold and Inheritance of the Land premises and appurtenances aforesaid against whom a Common Recovery may be had perfected and executed in such manner as herein after mentioned And for that purpose it is hereby covenanted concluded and agreed by and between all the said parties to these presents that before the end of April Provincial Term in this present year one writ of Entry sir desseisin en le post shall and may be brought and prosecuted returnable to the said provincial Court in the Name of the said Thomas Johnson as plaintiff or Demandant against the said Charles Carroll as Tenant whereby the said Thomas Johnson Junior shall demand against the said Charles Carroll the said Lands and premises with the appurtenances by such apt and convenient Name and |
