451 Tract of Land called The Back Land lying and being in the same County containing four Hundred Acres of Land more or less and also all that Tract of Land called the Two Brothers lying and being in the same County containing two hundred and twenty five Acres of Land more or less with the appurtenances to the same and every part thereof belonging or in any wise appurtaining together with all Houses Outhouses Conveniencies Ways Waters Water Courses Rents Issues Profits Emoluments and Benefits to the same Lands and each and every of them belonging And also all the Right Title Interest Claim Estate and Property whatsoever of them the said John Lucas and Ann Lucas and each of them in to and into the said Lands and premises and each of them with their and each of their Appurtenances To have and to hold the said Lands and premises and each and every of them with their Appurtenances to him the said Thomas Stone his Heirs and Assigns for ever In trust Nevertheless and for the use Intent and purpose that the said Thomas Stone or his Heir shall by good and sufficient Deed or Deeds Conveyance or Conveyances or Instruments in writing valid and effectual in Law convey transfer and make over unto him the said John Lucas his Heirs and Assigns for ever one undivided Moiety or half part of the said Tracts of Land and Premises and each of them with the appurtenances And also that the said Thomas Stone or his Heirs shall by good and Sufficient Deed or Deeds Conveyance or Conveyances or Instruments in writing valid and effectual in Law convey transfer and make over to her the said Ann Lucas her Heirs and Assigns for ever one other undivided Moiety or half part of the said Tracts of Land and Premisses and each of them with the appurtenances in such a Manner that the said John Lucas may be vested and seized in fee simple in and to one Moiety of the said Lands and Premisses and each of them with their Appurtenances and that the said Ann Lucas may be vested and seized in fee Simple in and to one other Moiety of the said Lands and Premisses and each of them with their Appurtenances to have and to hold the said Lands and Premisses and each and every of them with their Appurtenances to them the said John Lucas and Ann Lucas and their respective Heirs and Assigns for ever by Moieties as Tenants in Common and not as Joint tenants In Witness whereof the Parties to this Indenture have hereto sett their Hands and seals the day and year aforesaid Signed sealed and delivered in Presence of W.m Hayward T Stone (seal) Jn.o Lucas (seal) Ann Lucas (seal) Jacob Henderson Hindman On the Back of the aforegoing Deed was thus Endorsed (Viz.t) On the sixteenth Day of April in the Year Seventeen hundred and seventy three Came personnally before Me the Subscriber one of his Lordships Justices of the Provincial Court the within named John Lucas and Ann Lucas who then severally acknowledged the within Indenture to be their Act and Deed and the Act and Deed of each of them and the Lands and Premises within mentioned and every of them with their appurtenances to be the Right Title and Estate of him the said Thomas Stone his Heirs and Assigns for ever for the Uses Intents and purposes and under the Trusts in the said Indenture expressed Previous to which said Acknowledgment of her the said Ann Lucas I examined her the said Ann Lucas privately out of the Hearing of the said John Lucas her Husband upon which Examination she confessed and declared to me that she made the said Indenture and Acknowledgement willingly and freely without being induced thereto by Fear or Threats of Ill usage by her said Husband or Fear of his Displeasure W.m Hayward 8 Sides Recorded the 16.th of April 1773 |
