449) or less The remaining part of the resurvey in George's Mistake George's Venture and the Barrens Containing four hundred and Eighty five Acres more or less the same remaining part of the resurvey on Georges Mistake Georges Venture and the Barrens being heretofore Mortgaged to Barnabas Hughes and afterwards released to the aforesaid Daniel Hughes and Samuel Hughes by one George French One Bank containing one hundred and Eighteen Acres more or less being part of a Tract of Land called the resurvey on Nancy's Fancy Friendship containing one Hundred and Seventy three Acres more or less being part of the Resurvey on Discontent the Resurvey on the Three Springs containing One Thousand Six Hundred and Sixty Acres more or less The Resurvey on Waggoners Fancy containing Three Hundred and Ninety Seven Acres more or less The resurvey on Sarahs Delight containing Seven Hundred and seventy Acres more or less Kindness One Hundred and Seventy five Acres more or less Friendship containing Forty eight Acres More or less Wilkes and Liberty containing Eight Hundred and NIneteen Acres more or less except One Hundred and Twelve Acres which they said Daniel Hughes and Samuel Hughes are already obligated to Convey to a certain William Donwoody and John Cha^r^lton a Tract containing Fifty acres more or less ly.g adjoining a Tract call'd Ore Bank and which the said Daniel Hughes and Samuel Hughes purchased from a certain Jacob Gavelor also One Hundred and Sixty Six Acres being part of a Tract called Good Friday to be layd off adjoining the resurvey on Waggoners Fancy and the resurvey on Georges Mistake Georges Venture and the barrens being intended to make up the quantity of Seven Thousand Two Hundred and Eighty Two and an half Acres of Land more or less Togather with one undivided Moiety or half part of all Houses and Edifices Buildings, Gardens Orchards Ways Waters Water Courses woods underwoods Easements Priviledges Improvements Advantages and appurtenances whatsoever to the said Premises belonging or in any wise Appertaining and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and all the Estate Right Title Interest use Trust Possession Property Claim and demand both in Law and Equity of them the said Daniel Hughes and Samuel Hughes of into to or out of the same undivided Moiety or half part of the said Furnace, Forge, Lands and Tenements hereby conveyed or intended so to be the aforesaid Daniel Mildred his Heirs and Assigns to the only proper use and behoof of the said Daniel Mildred his Heirs and Assigns for ever and to or for no other use intent or purpose whatsoever And to Have and To hold the other undivided Moiety of the said undivided Moiety or half part of the said Furnace Forge Lands and Tenements hereby conveyed or intended so to be to the aforesaid John Roberts his Heirs and Assigns to the only proper use & behoof of the aforesaid John Roberts his Heirs and Assigns for ever and to and for no other use intent or purpose whatsoever as Tenants in Common and not as Joint Tenants and the said Daniel Hughes and Samuel Hughes for themselves and their Heirs the said undivided Moiety or half part of the said Furnace Forge Lands and Tenements with the appurtenances unto them the sid Daniel Mildred and John Roberts and their Heirs against them the said Daniel Hughes and Samuel Hughes and their Heirs and all and every Person or persons claiming or to Claim by from or under them or either of them shall and will warrant and for ever defend by these presents In Witness whereof the said Daniel Hughes and Samuel Hughes have hereunto set their Hands and Affixed their Seals the day and year first above written Signed sealed and delivered Dan.l Hughes (seal) in the presence of Jn.o Smith (seal) Sam.l Hughes (seal) W.m Buchanan (seal) |
