387 Exa.d This Indenture made this twenty fifth Day of September in the Year of our Lord seventeen hundred and Seventy two Between Alethea Smith Parker of Prince Georges County Widow of the one part and John Baynes of the said County Gentleman of the other part Whereas the said John Baynes at the Special Instance and Request of the said Alethea Smith Parker did become Special Bail for the said Alethea Smith Parker in an Action of Debt commenced by John Glassford Assignee of James Marshall against the said Alethea Smith Parker in the Provincial Court Now this Indenture witnesseth that the said Alethea Smith Parker as well for and Indemnication and counter Security of the said John Baynes against all Debts Damages Costs and Charges which the said John Baynes shall pay or be compelable to pay by entring into the special Bail aforesaid as for and in Consideration of the Sum of five Shillings Sterling to the said Alethea Smith Parker in Hand paid by the said John Baynes before the Ensealing and Delivery of these presents the Receit whereof is hereby acknowledged hath bargained and sold and by these presents doth bargain and sell unto the said John Baynes and his Heirs the following Negro Slaves to wit one Negro Slave named Harry one named Ben one named Paris one named Hannah one named Milley one named Murreer one named Annekey one named Orange one named Terry one named Luckey one named Fanny one named Bet one named Meria to have and to hold the said Negro Slaves to him the said John Baynes his Heirs Executors Administrators and Assigns Provided always and these presents are upon this Condition that if the said Alethea Smith Parker shall well and truly indemnify and save harmless the said John Baynes from all Debts Damages Costs and Charges which the said John Baynes his Heirs Executors or Administrators shall pay or be obliged to pay in Consequence of his the said John Baynes becoming Special Bail as aforesaid for the said Alethea Smith Parker in the Action before mentioned that then this present Deed and Conveyance shall be null and void otherwise to be and remain in full Force and Virtue in Law In Witness whereof the parties to these presents have hereunto interchangeably set their Hands and affixed their Seals the Day and Year first above written Alethea S Parker (seal) Signed sealed and delivered In the presence of John Baynes (seal) Tho.s Jenings J Hepburn The above Deed was thus endorsed Viz.t Received on the Day and Year first within written of and from the John Baynes the Sum of five Shillings Sterling it being the Consideration Money within mentioned to be by him paid to me Witness Tho.s Jenings J Hepburn I say received by me Alethea S Parker On |
