265. the Consideration Money within mentioned to be by him paid to me I say received by Edw.d Stevenson Witness Will Deards Henry Sibell On the 23.d Day of Aug.t 1771 came before us the Subscribers two of his Lordships Justices of the Peace for Frederick County the within named Edward Stevenson & acknowledged the within Instrument of Writing to be his Act & Deed & the Lands & Premises within mentioned to be the Right & Estate of the within named Charles Carroll Esq.r his Heirs & Assigns according to the true Intent & Meaning of the within Deed & the Act of Assembly in such Case made & provided On the same Day & Year came also before us Rachel the wife of the aforesaid Edward Stevenson & she being by us privately examined apart from & out of the Hearing of her said Husband did release & relinquish to the aforesaid Charles Carroll & his Heirs all her Right TItle & Interest of Dower of in & to the Lands within mentioned with their Appurtenances & she also declared that she made such Release & this her Acknowledgement voluntarily & freely without being induced thereto by Fears or Threats of or ill Usage of her said Husband or through Fear of his Displeasure Charles Jones W.m Luckett Frederick County fs.t I hereby certifie that Charles Jones & William Luckett Gentlemen before whom the above Acknowledgment was taken & signed were at the Time of taking & signing the same & still are two of his Lordships the Right Honourable the Lord Proprietary's Justices of the Peace for the County aforesaid duly & legally authorized & assigned &.c and that to all Acknowledgments by them so taken & signed due Faith & Credit is & ought to be given as well in Justice Court as thereout In Testimony whereof I have hereunto set my Hand & affixed the Publick Seal of the said County this 2.d Day of November Anno Domini 1771 Tho.s Sprigg Clk Fred.k Co.ty Court LS Recorded Nov.r 14.th 1771 X.d This Indenture made this twenty ninth Day of August in the Year seventeen hundred & seventy one between Henry Rozer, Daniel Carroll & Notley Young, of Prince Georges County, in the Province of Maryland, Gentlemen, Trustees of Charles Carroll Esq.r of the same County for the Purpose of erecting a Town, called Carrolsburg, on Patowmack River, in the County aforesaid, of the one Part & Charles Carroll Esq.r of Carrollton of the other Part, Witnesseth, that the said Henry Rozer, Daniel Carroll and ' Notley Young for & in Consideration of the Sum of twelve Pounds Sterling Money (to) |
