227 same Premises the common Vouchee who shall thereupon appear and enter into the said warranty and after Imparlance make Default and such other and further Proceedings shall be had upon the said writ and all the said Parties shall so demean themselves therein that one good and perfect common Recovery with double Voucher shall and may be had suffered perfected and executed of for or upon the said Tracts of Land with their Appurtenances in all things according to the usual Course Order ^and^ Form of Common Recoveries with double Voucher for Assurance of Lands in such Cases used And it is further covenanted concluded declared and fully agreed by and between all the said Parties to these Presents for themselves and their Heirs and it is their true Intent and Meaning that the said common Recovery so as aforesaid or in any other Manner to be had suffered or executed of for or upon the said Tracts of Land and the full Force Effect and Execution thereof and also all & every other common Recovery or Recoveries or other Assurances had made suffered or executed or to be had made suffered or executed of for or upon the said Tracts of Land to which the said Parties to these Presents or any of them is or are or shall be Parties or Party or Privy shall be and enure and shall be construed expounded deemed & taken to be and enure in the Manner and to the Uses following to wit, As to touching and concerning all that Part (of the said first mentioned Tract of Land with the Appurtenances containing in the whole two hundred Acres) which lies to the Southward of a Creek called Bread and Cheese Creek and which Part contains eighty acres more or less to the only proper Use and Behoof of the said Thomas Shaw otherwise called Gash his Heirs and Assigns for ever and to or for no other Use Intent or Purpose whatsoever And as to touching and concerning the Residue of the same Tract with the Appurtenances to the only proper Use and Behoof of the aforesaid Benjamin Baxter his Heirs and Assigns for ever and to or for no other use Intent or Purpose whatsoever And as to touching and concerning all that the said other Tract or Parcel of Land containing forty one acres with the appurtenances to the only proper Use and Behoof of the aforesaid Ferdinando Batty his Heirs and Assigns for ever and to or for no other Use Intent or Purpose whatsoever In Witness whereof the Parties to these Presents have hereunto interchangeably set their Hands and affixed their Seals the Day & Year first above written Thomas Burgen (Seal) Ferdinando Battee (Seal) Signed seal'd and delivered in the Presence of Benjamin Baxter (Seal) Thomas Shaw otherwise Gash (Seal) Baker Johnson his Th.s Johnson Jun.r (Seal) Samuel S Lindall Mark |
