189 and also since the Death of the said James Wardrope in Payment according to the Provisoes and Covenants in the said recited Indenture of Release also since the Death of the said James Wardrope he the said John Buchannan according to the said recited Dues and their true Intent and meaning Did set up and expose to Sale the severall premises before mentioned with the Appurtenances at publick Vendue after due Notice thereof given at which Vendue he the said Anthony Stewart was the best and highest bider at and for the Sum of three hundred and eleven pound ten Shillings Pensilvania Currency Now This Indenture Witnesseth that the said John Buchannan for and in Consideration of the Sum of three hundred eleven pounds ten Shillings Pensilvania Currency to him in hand paid by the said Anthony Stewart the Receipt whereof he doth hereby acknowledge Hath given, granted, bargained, sold, aliened, remised, released and confirmed, and by these presents, Doth give, grant, bargain, sell, alien, remise, release and confirm unto the said Anthony Stewart his Heirs and Assigns all the aforesaid severall Tracts pieces or Parcels of ground or Land commonly called or known by the Names of Dear bought containing by Estimation five hundred Acres, Partnership Containing two hundred and Eighty Acres, Brentford containing thirty five Acres, and Piney Hill containing eighty six Acres be the same more or less scituate lying and being in Frederick County in the Province of Maryland aforesaid ^or^ by whatsoever other Name or Description the same is or shall be called known or described together with all Houses Edefices Buildings, Gardens, Orchards Ways Waters Water courses Commodities Improvements & Appurtenances whatsoever the said Tracts Pieces or Parcels of Land belonging or in any wise appertaining and the Reversion and Reversions Remainder & Remainders rents Issues and Profits thereof and of every part and parcell thereof and all the Estate, Right, Title, Interest, Use, Trust, Possession Property, Claim & demand whatsoever either in Law or Equity of him the said John Buchannan of in and to the same and every Part & Parcell thereof To have and to hold the said Tracts Pieces or Parcells of Land and every part and parcel thereof with the Rights Members and Appurtenances to him the said Anthony Stewart his Heirs and Assigns to the only proper use and Behoof of him the said Anthony Stewart Buchanan for himself, his Heirs Executors & Administrators doth hereby covenant and grant to and with the aforesaid Anthony Stewart his Heirs & Assigns that he the said John Buchannan and his Heirs the said Premises to him the said Anthony Stewart his heirs & Assigns from and against him the said John Buchannan and his Heirs and all and every other Person and Persons whatsoever Claiming or to Claim by or under him them or any of them shall and will warrant and for ever defend In Witness whereof the Parties to these Presents have hereunto interchangably set their Hands and affixed their Seals the Day and Year first above written Sealed & delivered John Buchanan (seal) in the Presence of by his Attorney James Dundass James Dick Charles Steuart |
