159. returnable and to be returned to the Provincial Court to be held at Annapolis the second Tuesday of April next whereby the said Thomas Jenings shall demand against him the said William Worthington all those Tracts of Plantable Land following lying in Anne Arundel County that is to say Homewood containing one hundred and forty Acres of Land Clarkstone containing one hundred Acres of Land Mosses Purchase containing one hundred Acres of Land Homewoods Range containing one hundred and fifty Acres of Land the Complement containing one hundred Acres of Land Limestone containing three hundred Acres of Land, Pawsons Plains containing four hundred Acres of Land, Cornfield plain containing one hundred Acres of Land, Homewoods Addition containing One hundred and fifty Acres of Land Homewood Town containing six hundred and thirty five Acres of Land Homewoods Outlet containing sixty two Acres of Land, Homewoods Enlargement containing One hundred Acres of Land, Homewood's Forrest containing one hundred Acres of Land, Howard's Range containing two hundred seventy Acres of Land Howards Pasture containing two hundred Acres of Land and Ornoaks containing One hundred and Ninety Acres of Land with the Appurtenances to the said Tracts of Land belonging to which said writ the said William Worthington shall appear and vouch thereof to warranty the Common Vouchee of the same Court and such further and other Proceedings shall be thereupon had that the said Thomas Jenings shall by Judgment of the same Court recover his Seisin against the said William Worthington of and in the demanded premisses and the said William Worthington shall recover over in Value against the Common Vouchee whereby a Common Recovery of the aforesaid Lands with the Appurtenances shall be had and suffered Now this Indenture Witnesseth that for settling and Declaring the Intent and Use of the said Recovery and for and in Consideration of the Sum of five Shillings sterling by him the said William Worthington to him the said Thomas Jenings in Hand paid the Receipt whereof is hereby acknowledged it is hereby covenanted granted and agreed & Declared by and between the said Parties to these Presents that the said Common Recovery so as aforesaid or in any other Manner to be had and suffered and the Execution thereof from and immedeately after the suffering the same or any other Recovery or Recoveries of the said Mentioned Premisses or any part thereof was meant and intended to be and enure and is hereby declared to be and enure and that the Recoveror therein named and his Heirs should and shall stand and be seized of and in the recovered Premisses and every Part and Parcel thereof to and for the only proper Use and Behoof of the said William Worthington his Heirs and Assigns forever In Witness whereof the Parties to these Presents have hereunto interchangeably set their hands and Seals the Day and Year first above written Sealed and Delivered Tho.s Jenings (seal) in Presence of W.m Harwood W.m Worthington (seal) On the Back of the aforegoing Deed was Endorsed as follows, to wit Received the Day and Year first within written by and from the within named Sterl.g William Worthington the sum of five Shillings Sterling being the Consideration £ s d Money within mentioned Tho.s Jenings 0 5 0 W.m Harwood On the 18th Day of April in the Year of our Lord one thousand seven hundred and seventy one came before me one of his Lordship's Provincial Justices the within named Thomas Jenings (and) |
