157. Charles County fs.t On the Eleventh day of January 1771 came James Kirk before us two of his Lordships Justices of the Peace for the County aforesaid and did then request us as Magestrates to witness the within mentioned Indented Deed of Bargain Sale and Assignment And we do Certifie that the said James Kirk did in our Presence sign seal and Deliver the same and did at same Time acknowledge it to be his Act and Deed for the Use and Purpose therein Mentioned and in Behalf of John Crosby & William Crosby Given under our hands the Day and Year above written Walter Hanson, James Craik recorded this 17th Day of April 1771 4¾ sides X.d This Indenture made the sixteenth day of April in the year of our Lord Seventeen hundred and seventy one Between John Brice of the City of Annapolis and Sarah Brice Executrix of John Brice late of the City of Annapolis deceased of the one part and Charles Carroll Esquire of said City Barrister at Law of the other Part Witnesseth that whereas Zacheus Onion of Baltimore County by his Conveyance or Deed of Mortgage made or mentioned to be made between him the said Zacheus Onion by the Name of Zacheus Onion of Baltimore County in the Province of Maryland Iron Master of the one Part and the said John Brice deceased by the name of John Brice of the City of Annapolis Esquire of the other part bearing Date the sixteenth Day of June in the year of our Lord seventeen hundred and Sixty four Duly executed acknowledged and Recorded in the Provincial Court Land Records in Liber DD N.o 3 Folios 354, 355, 356, 357, 358, 359, 360 and 361 for and in Consideration of the sum of one thousand four hundred & twenty pounds two shillings Sterling Money of Great Britain to him in hand paid among other things did Grant bargain Sell alien Enfeoff and Confirm unto the said John Brice deceased and his Heirs Eighty eight Acres of Land More or less called Onions Marshy Point Scituate on the south side of Gun Powder River in Back River Neck lying and being in the County and Province aforesaid Reference being had unto the said Conveyance or Deed of Morgage may more fully and at large appear and all and singular the Premisses therein mentioned or thereunto belonging and also the Reversion and Reversions Remainder and Remainders Right Estate Interest benefit Claims and Demands whatsoever of him the said Zacheus Onion of in or to all and singular the Premisses and every part and parcell of them To have and to hold the said Land and Premisses therein before mentioned and intended to be thereby Granted with their and Every of their Appurtenances unto him the said John Brice deceased his Heirs and Assigns and against all Persons whatsoever should and would warrant and Defend by these Presents Provided always and the said Presents were upon this Condition Nevertheless that if the said Zacheus Onion his Executors Administrators or Assigns should well and truly pay unto the said John Brice deceased hs Executors Administrators or Assigns the said Sum of one thousand four hundred and twenty pounds two Shillings Sterling Money of Great Britain with legal Interest for the same from the Date thereof at or upon the tenth Day of April which should be in the year of our Lord seventeen hundred and sixty eight without fraud or further delay then the said Deed of Mortgage was to be void and of no Effect else to be and remain in full force and virtue in Law Now this Indenture witnesseth that the said John Brice the son and Sarah Brice for and in Consideration of the sum of one hundred pounds Sterling Money of Great Britain to them in Hand paid before the sealing and Delivery of these Presents the Receipt whereof (they) |
