139 The above Goods being now out for Sale the Produce from the Sale thereof is agreed to be subject to the same deposition that the Goods and Chattles are by the Indenture hereunto annexed In Witness whereof we the subscribers have hereunto set our hands this thirtieth day of March Anno Dom 1771 Witness W.m Hayward frs Baker 20 sides Ja Lloyd Chamberlaine Recorded this 1.st day April 1711 x.d This Indenture made this ^twenty^ sixth day of November in the Year of our Lord one thousand seven hundred and seventy Between Anthony Steuart of the City of Annapolis Merchant of the one part and Reverdy Ghiselin of the City of Annapolis Gentleman of the other part Whereas Alexander Ferguson late of London Town Taylor deceased made his last Will and Testament in Writing whereby amongst other things he did Desire and Direct that his three Dwelling Houses in the City of Annapolis with all the Ground he had there which had been made over to him at four Different Times as might appear by Deeds on Record should be sold at Public Vendue and fully described in the Maryland Gazette at least Six or eight Weeks before the day of Sale and further Willed that they should be sold at a Provincial Court or at some other Public Time at Annapolis and the Money they should be sold for should be applied towards paying his just and lawful Debts of which same Will the same Alexander Ferguson appointed the aforesaid Anthony Steuart and a certain John Davidson together with his Wife to be Executors but the said John Davidson and Elizabeth the Wife of the aforesaid Alexander Ferguson both renounced the Executorship aforesaid and refused to prove or Execute the said Will and he the said Anthony Steuart hath caused the said Will to be duly proved and recorded in the Prerogative Court and hath taken on himself the burthen of the Execution thereof And hath also after six weeks successive Advertisements in the Maryland Gazette of the Sale of said Dwelling Houses and Ground before mentioned particularly and fully Describing the same in and by the said Advertisements set up and exposed to Sale by way of Public Vendue on the seventeenth day of this Instant Month of November in the Time of the General Assembly of this Province and County Court sitting on the Premisses the Dwelling House and piece or Parcel of Ground herein after mentioned with the appurtenances at which Vendue the aforesaid Reverdy Ghiselin was the best and highest Bidder at and for the sum of Six hundred and five pounds Pensylvania Current Money And also the other Parcel of Ground herein after mentioned and Described with the Appurtenances at which same Vendue the aforesaid Reverdy Ghiselin was also the best and highest Bidder therefor at and for the sum of one hundred and five pounds Pensylvania Current Money Now this Indenture Witnesseth that the said Anthony Steuart for and in Consideration of the said Sums of Six hundred and five Pounds and one hundred and five Pounds amounting together to the Sum of Seven hundred and ten Pounds Pensylvania Current Money to him in hand paid by the said Reverdy Ghiselin at or before the Sealing and delivery of these presents the receipt whereof he doth hereby acknowledge and thereof and therefrom doth release acquit and Discharge the aforesaid Reverdy Ghiselin his Heirs Executors Administrators and Assigns and every of them by these Presents Hath (granted) |
