136 adjoining said Robert Pinkney's division line with Joshua Fraizer And it is hereby Covenanted and agreed that if at any Time the said Robert Pinkney his Heirs or Assigns shall contrary to the Express words and meaning of this Agreement Build against said Elie Vallette's House or raise any Obstruction that many in any manner Obscure the windows in the same Except the Liberty hereby granted to lay a pile of wood as aforesaid on his the said Robert Pinkneys division Line with Joshua Fraizer that then and in such Case the said Elie Vallette may and shall reenter in the above Bargained Premisses and him the said Robert Pinkney thereout Expel and remove And the said Elie Vallette on the faithful performance of the above agreement Doth for himself his Heirs Executors and Admors Covenant Promise and Agree to and with the said Robert Pinkney his Exors Admors and Assigns that he the said Elie Vallette the hereby Bargained Premisses against all and every Person or Persons claiming by from or under him shall and will warrant and forever defend In Witness whereof the Parties to these presents have hereunto Interchangeably set their Hands and Seals the day and year above written Signed Sealed and Delivered Elie Vallette (Seal) in the Presence of Dan of S.t Tho.s Jenifer Rob.t Pinkney (Seal) R Dobinson On the Back of the aforegoing Deed was this Endorsed to wit Ann Arundel County to wit the 5th day of March 1771 Then Came before Me the Subscribers the within mentioned Elie Vallette and Robert Pinkney and Severally did Acknowledge the within Instrument of writing to be their Act and Deed for the Uses and Purposes within mentioned Recorded this 16th Day of March 1771 Dan of S.t Tho.s Jenifer 5¾ sides X.d This Indenture made the thirtieth Day of March in the Year of our Lord one thousand seven hundred and seventy one Between Francis Baker of Talbot County in the Province of Maryland Gentleman of the one part and James Lloyd Chamberlaine of the same place Gentleman of the other part Witnesseth that the said Francis Baker as well for and in Consideration of making the said James Lloyd Chamberlaine whole and securing him against any Injury that he may Suffer or Sustain by means of his engagement to Discharge a Judgment obtained by a certain James Hutchings of Kent Island in the Provincial Court against the said Francis Baker for Twelve hundred and nine pounds Seven Shillings Current Money and the Sum of Eight hundred and sixty seven pounds of Tobacco Cost of Suit as for and in consideration of the sum of five shillings Current Money of Maryland to him in Hand paid by the said James Lloyd Chamberlaine at and before the Execution hereof the receipt whereof he doth hereby Acknowledge hath Granted Bargained and Sold and hereby doth Grant Bargain and Sell Alien Release Convey and Confirm into the said James Lloyd Chamberlaine and to his Heirs and Assigns for ever All that Tract of Land called Skipton in the County aforesaid containing three hundred Acres and also all that two hundred Acres of Land part of a Tract of Land in the county aforesaid called Finneys Hermitage whereof the said Francis is possessed in Virtue of his intermarriage with a certain Frances Clayland and also all that twenty nine acres part of the said Tract called Bite the Biter and that one Acre of Land part of the Tract called Skipton whereon the said Francis now lives and which was by him purchased from James Seth One Negro Man Slave Named Pomp about thirty five Years of Age One Negro Man slave named Cæsar about thirty Years of Age One Negro Man Slave Named Pompey about forty five Years of Age One Negro Woman Slave named Nan about Twenty five (Years) |
