134 and year aforesaid to the said Nathaniel Waters is Described and Bounded as follows to wit, Beginning at a Locust Post standing in the westermost side of South East Street and running thence North West with the said Street Twenty seven feet and half a foot to the Church Circle and running by and with the said circle to the Eastermost side of South Street then running with the said Eastermost side of South Street South thirty feet and then running South thirty three Degrees East sixty three feet and half a foot and thence with a Streight Line to the Beginning Locust Post containing six thousand Eight hundred Seventy two and a half square feet together with all and every the Houses Buildings and Improvements to the said Premises belonging unto him the said Joshua Fraizer his Heirs Executors Admors and Assigns from the Day before the Date of these presents for and during and unto the full End and Term of Ninety nine years from thence next ensuing fully to be compleat and ended renewable forever under his proportionable part of the Rents and Covenants above mentioned Provided Nevertheless and it is the full intent and meaning of these Presents that no part of the hereby Bargained premises shall be the said Joshua Fraizer his Heirs Exors Admors or Assigns be Enclosed or any ways Occupied Except such part thereof as now is within Inclosures so that there may be left Inclosed such and so much of the said Bargained premises next adjoining to the present Palings and Inclosure of Daniel Dulany Senior Esquire as shall be sufficient for a Street for and during as long a Time as the said Inclosure of the said Daniel Dulany Esq.r shall be permitted and suffered by the Corporation of the City of Annapolis and no longer And Whereas the aforesaid Daniel Dulany Junior is since arrived at full age and at the request of the aforesaid Joshua Fraizer for the better assurance and Title of him the said Joshua Fraizer of in and to the premises aforesaid is willing and now ready to confirm the Lease of the above mentioned Lot of Ground so as aforesaid made during the Minority of the said Daniel Dulany by Walter Dulany Esquire his Guardian to Cornelius Garretson in Manner and form as is above mentioned Now Know Ye that the said Daniel Dulany Jun.r Doth by these presents ratify and confirm all and every Matter Clause or Thing contained mentioned and Agreed to in the aforementioned Lease made so as aforesaid on the 16th day of March Seventeen hundred and fifty Nine between Walter Dulany Esq.r and Cornelius Garretson And Whereas by the Tenor of the aforesaid Lease so as aforesaid made with Cornelius Garretson the above Lot is chargeable with a Yearly Rent of four pounds Sterling Money of Great Britain to be paid to said Daniel Dulany in yearly payments of which of four pounds Sterling the proportionable part to be paid by Joshua Fraizer is forty Shillings of same Money And the said Joshua Fraizer being desirous of purchasing the Fee Simple of his part aforesaid of said Lot in consideration whereof he did unto the said Daniel Dulany the Receipt of which is hereby Acknowledged the said Daniel Dulany Doth hereby in consideration of the said payment for himself his Heirs Executors & Administrators Grant Bargain Sell Transfer Assign and Set over unto him the said Joshua Fraizer and his Heirs and Assigns all his Right Title and Interest of in and unto that that part of the Lot Number fifty aforesaid which is not included within the Lines of that part thereof conveyed as aforesaid by Daniel Dulany Esq.r and Henrietta Maria his Wife to Edward Dorsey nor also in that part of said Lot conveyed as aforesaid by Cornelius Garretson to Nathaniel Waters And the said Daniel Dulany for himself his Heirs Executors and Admors Doth Covenant Promise and Grant (to) |
