133 Date the 16.th day of March in the Year of our Lord one thousand Seven hundred and fifty nine made and concluded between Walter Dulany Esquire Natural Guardian of Daniel Dulany the Son of him the said Walter Dulany of the one part and Cornelius Garretson of the other part He the said Walter Dulany as Natural Guardian of his said son Daniel for the Consideration therein mentioned Did Demise Grant and to Farm let unto the said Cornelius Garretson all that Lot or Parcel of Ground lying and being in the Old Town of the City of Annapolis distinguished in the Plot of the resurvey thereof made by James Stoddart on or about the 25th day July 1718 by the Number Fifty Except one part of said Lot on the second Day of April Seventeen hundred and forty eight by Daniel Dulany Esq.r and Henrietta Maria his Wife conveyed to Edward Dorsey which said part of the Lot N.o 50 so conveyed by Daniel Dulany Esq.r and Henrietta Maria his Wife to Edward Dorsey as aforesaid is bounded and circumscribed within the following Lines, to wit, Beginning at the End of the North East line of said Lot Number fifty in the Line of South East Street and running with said Street North West Fifty three feet and half a foot then South Thirty five Degrees West one hundred and nineteen feet then South east fifty three feet and half a foot then with a Streight Line to the Beginning containing Six thousand three hundred and sixty six and one half square feet To have and To hold the said Lot and Parcel of Ground N.o 50 (Except as before Excepted) unto him the said Cornelius Garretson his Executors Admors and Assigns from the Day next before the Day of the Date of the said Indentures for and during and until the full end and Term of Ninety nine years from thence next ensuing fully to be compleat and ended And the said Walter Dulany his heirs and Assigns should and would at the End and Expiration of the said Term of Ninety nine years upon the request and at the Cost and Charge of the aforesaid Cornelius Garretson his Exors Admors and Assigns Make Seal Deliver and in Due form of Law Execute and fully Perfect one other Lease and Demise of the hereby Demised Premises for other Ninety nine Years then next following and at the End and Expiration of the said last mentioned Term should also Lease and Demise the Said demised Premises for other Ninety nine Years and so from Time to Time should make such renewment for ever Now this Indenture Witnesseth that the said Cornelius Garretson for and in Consideration of the Sum of five Shillings Sterling Money to him in Hand paid by the aforesaid Joshua Fraizer at and before the Sealing and Delivery of these Presents the receipt whereof he doth hereby acknowledge Hath Bargained Sold Assigned transferred and set over and by these Presents Doth Bargain Sell Assign Transfer and set over unto him the said Joshua Fraizer all the rest residue and Remainder of the aforesaid Lot Number Fifty (not heretofore conveyed either by Daniel Dulany Esq.r and Henrietta Maria his Wife to Edward Dorsey as aforesaid nor by the aforesaid Cornelius Garretson to Nathaniel Waters in and by Virtue of the herein after resited Deed) and all his the said Cornelius Garretson's Right Title Interest Property Claim and Demand whatsoever of in and to the same To have and To hold the said rest residue and Remainder of the aforesaid Lot N.o 50 (Except as before Excepted all that part of said Lot conveyed as aforesaid said Daniel Dulany Esq.r and Henrietta Maria his Wife to Edward Dorsey as also all that part and parcel of the said Lot N.o 50 on the 18th day of March in the year of our Lord seventeen hundred and fifty nine By the aforesaid Cornelius Garretson Bargained Sold and Confirmed unto a certain Nathaniel Waters of Ann Arundel County which said part or parcel hereby intended to be Excepted Sold and Conveyed as aforesaid on the Day (and) |
