101 And the said Daniel Dulany and Lloyd Dulany for themselves their Heirs Executors and Administrators Do Covenant promise grant and agree to and with the said Richard lee his Heirs Executors Administrators and Assigns that if the said James Russell shall not pay or secure to be paid to the said Philip Thomas Lee such sum or sums of Money as above mention and within the Time herein before limitted that they the said Daniel Dulany and Lloyd Dulany and the Survivors and Survivor of them his or their respective Heirs Executors Administrators and Assigns upon convenient Notice to them given shall and will at the Cost of the said Richard Lee reconvey and transfer unto the said Richard Lee his Heirs and Assigns all and every the Lands and premises aforesaid with their and every of their appurtenances In Witness whereof the said parties to these presents have hereunto set their hands and seals the Day and Year first above Written Sealed and delivered in the Rich.d Lee (seal) presence of Bened.t Calvert Dan.l Dulany (seal) Dan of S.t Tho.s Jenifer Lloyd Dulany (seal) at the bottom of the aforegoing Deed was thus endorsed viz Received the Day and year within mentioned of the within named Daniel Dulany and Lloyd Dulany the sum of five Shillings Sterling 0 5 0 being the Consideration money within mentioned p.r Rich.d Lee Be it remembered that the within named Richard Lee came before me the Subscriber one of his Lordship's the Lord Proprietary's Justices of the Provincial Court and acknowledged the within Deed to be his Act and the Lands and Premises with their appurtenances therein mentioned to be the Estate of the within Named Daniel Dulany and Lloyd Dulany their Heirs and Assigns for the uses Intents and purposes within mentioned Taken and certified according to the Act of Assembly this 5.th Day of October in the Year of our Lord One thousand Seven hundred and Seventy 23 Sides Recorded 27.th November 1770 Dan of S.t Tho.s Jenifer This Indenture made this twenty Seventh Day of November in the Year of our Lord One thousand Seven Hundred and Seventy Between Nicholas Gassaway of Anne Arundel County and Province of Maryland of the one part And Henry Gassaway (son of Nicholas) of the same County and Province of the other part Witnesseth that the said Nicholas Gassaway for and in Consideration of the sum of Two hundred pounds Sterling Money to him in (hand) |
