733 Graham and his Heirs shall and will from time to Time and at all times hereafter warrant and Defend the aforesaid Land and Premises with the Appurtenances herein before granted Bargained sold Aliened Enfeoffed and Confirmed from and against all Manner of Person or Persons whatsoever Provided always and it is the true Intent and Meaning of these Presents that if the said Richard Graham his Heirs Executors or Administrators shall well and truly pay unto the said Nicholas Maccubbin his Executors Administrators or Assigns the said sum of one hundred and sixty six Pounds thirteen Shillings and four pence Sterling Money of Great Britain or any other Sum of Sums of Money that shall be Advanced unto the said Richard Graham by the said Nicholas Maccubbin at the Dwelling House of the said Nicholas Maccubbin in the City aforesaid with Legal Interest thereon that then these Presents shall be Void & of none Effect otherwise to be and remain in full force and the said Richard Graham do by these Presents bind himself his Heirs Executors and Administrators to pay the said Money and the Interest accordingly also the Cost of Drawing and Recording the said Mortgage In Witness whereof the said Richard Graham hath hereunto sett his hand and Affixed his Seal the Day and Year first above Written Signed Sealed & Delivered in the Presence of John Murray son of Josephus Jn.o Johnson Richard Graham (seal) On the Back of the aforegoing Mortgage was thus Endorsed Viz.t Received the Day and Year within mentioned of the within named Nicholas Maccubbin the within Sum of one hundred and sixty six Pounds thirteen Shillings and four pence Sterling Money of Great Britain it being the Consideration Money within mentioned as Witness my hand Witness Jn.o Johnson Richard Graham On the Twenty seventh day of April seventeen hundred Seventy Came the within named Richard Graham before me the Subscriber one of his Lordships Justices of the Provincial Court for Maryland and Acknowledged the within Deed to be his Act and Deed and the Land and Premises therein Bargained sold Aliened Enfeoffed & Confirmed to be the Right Title and Estate of the within Named Nicholas Maccubbin his Heirs and Assigns forever according to the true Intent and Meaning of the said Deed and the Act of Assembly in such Cases made & Provided 10¼ Sides Recorded 27.th April 1770 Philip Thomas Lee |
