714 lying and being in Anne Arundel County containing Acres To Have and to Hold the said Tract of Land with the Appurtenances unto the said Edmond Waymon his Heirs and Assigns To the Intent and Purpose that the said Edmond Waymon may be perfect Tenant of the Freehold and Inheritance of the said Tract of Land with the Appurtenances against whom a Common Recovery of the said Tract of Land with the Appurtenances may be had suffered and perfected at the next Provincial Court in which said Common Recovery it is hereby Agreed that the said Thomas Jenings shall be Demandant and the said Edmond Waymon Tenant and the said Mary Waymon shall be Vouchee and she shall Vouch over the Common Vouchee after the Manner and Course of a Common Recovery for Assurance of Lands And it is hereby further covenanted concluded declared and fully Agreed by and between all the said Parties to these Presents that the said Common Recovery so or in any other Manner to be had and suffered as aforesaid of the said Tract of Land with the Appurtenances between the said Parties to these Presents shall be deemed Adjudged and taken and so is meant and Intended and is hereby Expressly Declared by all and every of the Parties to these Presents to be and enure to the only proper Use and Behoof of the said Edmond Waymon and his Heirs for ever In Witness whereof the said Parties have hereunto set their Hands and Seals the day and Year first above written Sealed and Delivered Tho.s Jenings (Seal) The Mark of In Presence of Edmond EW Waymon (seal) And Scott The Mark of Mary M Waymon (Seal) On the Back of the aforegoing Deed was thus Endorsed Viz.t March 30.th 1770 Then received of M.r Edmund Waymon the Sum of s five Shillings Sterling being the Consideration Money within 0 5 0 mentioned Witness And Scott The Mark of Mary M Waymon April 16.th 1770 Then came the Parties to the within Deed and Acknowledged the same to be their Several Acts and Deeds to and for the Several Uses Intents and Purposes therein mentioned according to Act of Assembly in that Case made and Provided 5¼ Sides Recorded 16.th April 1770 W.m Hayward X.d This Indenture Tripartite made this first day of March in the Year seventeen hundred and Seventy Between John Rogers of the first part William Jackson of Saint Mary's County Planter of the second part and Jeremiah Evans of Saint Mary's County Planter of the third part Witnesseth that the said Jeremiah Evans for and in Consideration of the Sum of five Shillings Sterling Money to him in hand paid by the said William Jackson at or before the Ensealing and delivery of these Presents the receipt whereof is (hereby) |
