691 Acknowledged her ^Right^ of Dower of the within Land and Premisses to be the Right and Estate of the within Named John Welty his Heirs and Assigns for ever without any Threats or fear of the Displeasure of her said Husband as Witness our hands Sam.l Worthington John Moale Maryland Baltimore County to wit I hereby Certify that Samuel Worthington and John Moale both of the County aforesaid Gentlemen before whom the aforegoing Acknowledgment was made & taken were at the Time of making and taking the same and still are two of the Right Honourable the Lord Proprietary his Justices of the Peace for the County aforesaid duly and legally Authorized Commissioned and sworn and that to all such Acknowledgments so taken & subscribed due Faith and Credite is and ought to be given as well in Justice Court as thereout In Testimony whereof I have hereto set my hand and Affixed L S the Seal of the County aforesaid this Nineth Day of April Annoq Domini Seventeen Hundred and seventy A Lawson Cl of Balt County Court Receiv'd of John Welty the sum of four Shillings and five pence Sterling it being the Alienation Fine on the within Land for the Use of Lord Baltimore by Virtue of a Commission from John Morton Jordan his said Lordships Agent and Receiver General J Brice Recorded 10.th April 1770 8 Sides X.d This Indenture made the Second day of Aprill in the Year of our Lord One Thousand seven hundred and seventy Between Samuel Owings Junior of Baltimore County and Province of Maryland of the one part and Philip Nell of Frederick County and said Province of the other part Witnesseth that the said Samuel Owings Jun.r for and in Consideration of the Sum of Thirty six Pounds Currant Money to him in hand paid by the said Philip Nell the receipt of which the said Samuel Owings Jun.r doth hereby Acknowledge himself to be therewith fully Sattisfied Contented and paid Hath given granted Bargain'd Sold Aliend Enfeoffed and Confirm'd and by these Presents doth give grant Bargain Sell Alien Enfeoffe and Confirm him the said Philip Nell his Heirs and Assigns forever all that part of a Tract or Parcel of Land called the Resurvey on Owings Chance lying and being in Frederick County aforesaid which is Contain'd within the following Metes and Bounds Courses and Distances Viz.t Begining for the part hereby Bargain'd and Sold at the end of the third Line of a Tract of Land called the Addition to Landstool and runing thence North Seventeen West Eighty four Perches North a Eleven East forty Perches West one Perch South Thirty seven West one Hundred Thirty nine Perches South sixty seven East Hundred Pearches and then by a Direct Line to the Begining Containing Forty Eight Acres of Land together with all Rights Proffits Benefitts Priviledges & Advantages Premises and Appurtenances to the ^said^ Bargain'd Parcel of Land belonging or in any wise Appertaining To Have and to Hold the said Bargain'd Parcel of Land with the Premises and Appurtenances unto him the said Philip Nell his Heirs and Assigns forever and to his and their only proper Use and Behoofe and the said Samuel Owings Jun.r for himself and his Heirs doth hereby Covenant and grant Promise and Agree to and with the said (Philip) |
