(487) or otherwise however To have and to hold all and singular the aforesaid several Tracts or Parcels of Land and Premisses with their and every of their Rights Members and Appurtenances unto him the said Charles Carroll his Heirs and Assigns for ever whatsoever And the said Joseph Ensor for himself his Heirs Executors and Administrators hereby covenants and agreed to and with the said Charles Carroll his Heirs and Assigns that he the said Joseph Ensor his Heirs Executors and Administrators the aforesaid several Tracts or Parcels of Land and premisses with their and each and every of their Rights Members and Appurtenances to him the said Charles Carroll his Heirs and Assigns against him the said Joseph Ensor and his Heirs and against all other Persons whatsoever will Warrant and for ever Defend by these presents Provided always and it is the true Intent and Meaning of these Presents That in Case the said Joseph Ensor his Heirs Executors Administrators or Assigns shall well and truly pay or cause to be paid unto the said Charles Carroll his Executors Administrators or Assigns all such sum and sums of Money due and to grow due on the said recited Mortgage and which shall be paid by him the said Charles Carroll his Heirs Executors Administrators or Assigns with legal Interest thereon from the Time or Times the same shall be so paid and also the said sum of thirteen hundred and ninety one Pounds Sterling Money now Advanced by the said Charles Carroll to the said Joseph Ensor with legal Interest on the said last mentioned Sum of Money from the Date hereof at or before the Third Day of December which shall be in the Year of our Lord seventeen hundred and seventy one without Fraud or further Delay then this Indure or Deed of Mortgage to be Void otherwise to remain in full Force and Virtue in Law and the said Joseph Ensor for himself his Heirs Executors and Administrators hereby further Covenants and Agrees to and with the said Charles Carroll his Heirs Executors Administrators and Assigns that the said Joseph Ensor his Heirs Executors and Administrators all such sum and sums of Money now due and to grow due on the said recited Mortgage and which shall be paid as aforesaid by the said Charles Carroll his Heirs Executors Administrators or Assigns with legal Interest thereon from the Time or Times the same shall be paid and also the said sum of Thirteen hundred and ninety one Pounds Sterling Money with legal Interest thereon from the Date hereof together with the Charge of recording this Deed of Mortgage shall well and truly pay and satisfy to him the said Charles Carroll his Heirs Executors Administrators or Assigns on or before the third Day of December which shall be in the Year of our Lord seventeen hundred and seventy one In Witness whereof the Parties have to these presents hereunto interchangeably set their Hands and Seals the Day and Year first above Written Signed Sealed and Delivered Joseph Ensor (seal) in the Presence of Tho.s Johnson Jun.r Baruch Williams On the Back of the aforegoing Mortgage was thus Endorsed December the third 1768 Then received of the within Mentioned Charles Carroll (the) |
