355) the Original to the beginning Trees Containing and laid out for Six hundred and seventy five Acres more or less together with all and singular the improvements and Advantages to the said Tract of Land belonging or any ways appertaining to the only proper use and behoof of him the said John England his Heirs and Assigns for ever and to no other use intent or purpose whatsoever To have and to hold the aforesaid Tract of Land together with the Appurtenances unto him the said John England his Heirs and Assigns forever and the said Michael Swoope doth for himselfe and his Heirs hereby covenant promise grant and agree to and with the said John England his Heirs and Assigns shall and may have hold occupy and Enjoy the aforesaid Land and premisses together with the Appurtenances warranted and defended as well against him the said Michael Swoope as against all other persons lawfully claiming or to claim ^from^ by or under him In Witness whereof the said Michael Swoope hath hereunto sett his Hand and seal the Day and Year first Written Signd Seald and Delivered in presence of the following words Interlined before signing and ensealing viz.t the word /pounds/ between the fourth and fifth lines the word /County/ Mich.l Swoope (seal) between the eleventh & twelfth Lines the words /South twelve Degrees West eighty perches/ between the fourteenth & fifteenth Lines the word (Perches) between the eighteenth and nineteenth Lines the words (eighty three) between the forty first & forty second Lines Test as above Ben.t Swope bernod soltzingor 19.th Novem.r 1767 Then received of John England party to this Deed the sum of Thirty three pounds and fifteen shillings sterling Money of Great Britain it being the Consideration Money Due for the within bargained premisses I say received by me bernod soltzinger Mich.l Swoope The 19.th Novem.r 1767 then came Michael Swoope party to the within Deed before us the Subscriber two of this Lordships Justice for Frederick County and acknowledged the within Deed to be his Act and the Land and premisses therein mentioned to be the right title Estate and Inheritance of the within named John England his Heirs and Assigns for ever according to the Directions of an Act of Assembly of this Province in that case made and provided Acknowledged before Sam.l Owings R Richards 1767 Decem.r 16 Rec.d of M.r John England the sum of one pound six shillings and seven pence sterling for the use ^of^ Lord Baltimore being the Alienation Fine on the within Land and by virtue of a Commission from Edward Lloyd Esq.r his said Lordships Agent & receiver General 11 sides Recorded the 16.th Day of December 1767 J Brice |
