(234) May 12.th 1767 Came before me the Subscriber one of his Lordships Provincial Justices the within named Charles Ridgley and Acknowledged the within instrument of writing to to be his Act and Deed and the Lands and premisses within mentioned to be the Right and Estate of the within named Darby Lux and Rachel his wife for and during their natural Lives and the Survivor of them during the Life of Such Survivor and from and after the Decease of Such Survivor then the within named William Lux and the heirs of his Body forever and for want of Such heirs to the heirs of the Bodies of them the said Darby Lux and Rachel his wife and the heirs of the Bodies of such Heirs last aforesaid forever according to the true Intent and Meaning of the within Deed and the Act of Assembly in Such Case made and Provided Before J Hepburn 1767 May 19.th Received of M.r Darby Lux the Sum of Eight Shillings and Eight Pence sterling for the use of Lord Baltimore being the Alienation fines on the within Lands and by virtue of a commission from Edward Lloyd Esq.r his said Lordships Agent and receiver General John Brice 6 Sides Recorded the 20.th May 1767 Exam.d This Indenture made the third day of March in the Year Seventeen hundred and Sixty Seven Between William Barney of Baltimore County in Maryland Innholder and Frances his wife of the one part and John Beale Bordley of the same Place of the other part Witnesseth that the said William Barney and Francis his wife for and in consideration of the sum of Six hundred pounds Current Money to them by the John Beale Bordley in hand already paid the receipt whereof they hereby Acknowledge Have Granted Bargained and Sold aliened and transferred And by these presents they the said William Barney and Francis his wife Do Grant Bargain and Sell alien transfer and Confirm unto the said John Beale Bordley and his Heirs and Assigns for ever All that tract Peice or Parcell (or Tracts Peices or Parcells) of land whereon the said William Barney and Frances his wife lately lived (and which they yet have in Possession) called or known by the Name of Barney's Inheritance or by whatever name or names the Same is or are hath or have been called or known being Situate on and near to a Branch of Bear Creek in Baltimore County aforesaid containing two hundred and ninety Seven Acres or thereabouts And all Estate Right Title Interest Claim and Demand whatsoever of them the said William Barney and Frances his wife or either of them of in or to the said Land with the appurtenances thereto belonging Together with all Power and Equity of Redemption whatsoever both in Law and Equity which the said William Barney and Frances his wife or either of them their or either of their Heirs or Assigns might or could have or can or may have or claim by force means or virtue of any Condition Defeasance Clause or Agreement or otherways or (means) |
