(102) Charles County aforesaid which John Ward deceased devised in Tail to his son Thomas Ward also deceased containing One hundred Acres of Land with the appurtenances thereto belonging to which said Writ ^the said^ David Lindsey Ward shall and will appear in his proper ^person^ or by his Attorney or Attorneys lawfully authorised and impowered and vouch to warranty thereof the Common Vouchee who Shall thereupon Appear and enter into the same Warranty and after Imparlance make default and such further and other proceedings Shall be therein had so that one or more good and perfect Common Recovery or Recoveries with Single Voucher shall and may be had suffered perfected and executed in all things according to the usual form of Common Recoveries with singal voucher for Assurance of Lands in such cases used and accustomed Now this Indenture Witnesseth that the settling and declaring the Intent use and purpose of the said Recovery or Recoveries so to be suffered as aforesaid and for and in consideration of the sum of Ten Shillings Current Money by him the said David Lindsey Ward to the aforesaid James Tilghman in hand paid the Receipt whereof the same James Tilghman doth hereby acknowledge It is covenanted granted agreed and declared by and between the said Parties to these presents that the said Common Recovery or Recoveries so as aforesaid or in any other manner to be had and suffered and the Execution thereof from and immediately after the suffering the same or any Recovery or Recoveries of the said mentioned premisses or any part thereof shall and is and ar hereby intended to be and enure and shall be adjudged construed deemed and taken and is and are and was and were meant and intended and is and are hereby declared to be and enure and the Recoveror or Recoverors in the said Recovery or Recoveries named or to be named and he and they and his and their Heirs shall stand and be seised of the said Land and Premisses with the Appurtenances and every part and parcell thereof to and for the only proper and behoof of him the David Lindsey Ward his Heirs and assigns forever and to and for no other use intent or purpose In Witness whereof the parties to these presents have hereunto interchangeably set their Hands and affixed their seals the Day and year first above Written Sealed and delivered Ja Tilghman 3.d (seal) in the presence of James Dixon David Lindsey Ward (seal) Tho.s Town |
