(68) shall appear and Imparle and afterwards make Default whereby one or more Recovery or Recoveries Judgment or Judgments may be had and given for the said Edward Dorsey for Recovery of the said Tract or Parcel of land and Premisses with the Appurtenances against the said Henry Gassaway and for the said Henry Gassaway to recover over in Value against the said John Gassaway and for the said John Gassaway to recover over in Value against the Common Vouchee according to the Manner and Form of Common Recoveries in such cases used And it is further covenanted granted concluded agreed and declared by and between all and every the Parties to these presents and the true intent and meaning of the Parties to these presents is that from and immediately after the said Common Recovery or Recoveries shall be had prosecuted and suffered as aforesaid of the said Premisses the said Recovery or Recoveries shall be and enure and shall be construed esteemed adjudged and taken to be and enure and are hereby declared to have been intended to be and enure That the said Edward Dorsey and all and every other Person and Persons which shall be seized of the Premisses or any part thereof by Force or Virtue of the said Common Recovery or Recoveries shall stand and be seized thereof and of every part and Parcel thereof with their and every of their Appurtenances to the only Use and Behoof of the said John Gassaway his Heirs and Assigns and to no other Use Intent or Purpose whatsoever In Witness sides whereof the Parties to these Presents have hereunto interchangeably set 8 their Hands and Seals the Day and Year first above Written Sealed and Delivered in the Presence of Jn.o Gassaway (seal) Hy Woodward Sam.l Chapman Henry Gassaway (seal) Recorded 4th February 1760 E Dorsey (seal) |
