(252) Provincial Court to Prosecute out of the High Court of Chancery one or more Writ or Writs of Entry Sur Disseisin en le post against the said Alexander Frasier returnable to the next Provincial Court whereby the Said Bennet Chew shall and may demand against the Said Alexander Fraser All that TRact or Parcel of Land called Starlings Nest containing five hundred and fifty Acres of Land lying and Scituate in Calvert County on the West Side of the Main Branch of Fishing Creek Beginning at a marked Locust standing by the side of the said creek and running northerly one hundred and five Perches to a marked Pock Hickory being a bounded Tree of the Land of Anthony Salloway and with the said Salloways Line running One hundred forty and five perches to a marked Poplar being a Corner Tree of the Land of Richard Wells called Wells's Hills and with the Line of the said Land West thirty perches to a marked Chesnutt Tree and from the said Chesnutt running West two hundred Sixty and Eight perches to a marked Oak standing by a branch Side and from the said Oak running South three hundred and forty five Perches to a marked Poplar and from the said Poplar running east to a marked red Oak standing in the Main Branch of Fishing Creek and with the said Branch and Creek to the first Tree by such name or names Quantity or Quantities Quality or Qualities Content or Number of Acres as Shall be thought fit and requisite unto which Said Writ or Writs the said Alexander Fraser shall appear in proper Person and Vouch to Warranty the said Christian Adair who shall appear gratis upon the Voucher and shall enter into Warranty and Vouch over to Warranty the Common Vouchee and the Common Vouchee shall appear and imparle and afterwards make Default whereby one or more Recovery or Recoverys Judgment or Judgments may be had and given for the said Bennett Chew for Recovery of the said Lands and Premisses against the said Alexander Fraser and for the said Alexander Fraser and for the said Alexander Frazier to recover over in Value against the said Christian Adair and for the said Christian Adair to recover over in Value against the Common Vouchee according to the form of Common Recoveries in Such Cases used And it is further (Covenanted) |
