(238) said Lands and Premisses Mortgaged by the said Indenture And whereas the said Henry Woodward hath been obliged to lay out great Sums of Money and must necessarily lay out further large sums to work and occupy the said Mortgaged Premisses so as to gain and draw a Profit therefrom equal to the interest of the aforesaid Principal Consideration of the said Mortgage which cannot be prudentially done unless the Premisses were assured for a certain Term which is Assertained according to the true Intent of the Provisoes herein after Mentioned Now this Indenture Witnesseth That the said Charles Homewood for the more effectual securing the Principal Consideration Money of the said Mortgage the better to enable the said Henry Woodward to draw a Profit from the said Land adequate and equal to the interest of the said Principal Consideration Money of the said Mortgage and Effectually to burthen the said Mortgaged Premisses with the Payment of the said Sum of Two hundred and Ninety Nine Pounds and Interest thereupon advanced and paid to and for him the said Charles Homewood as aforesaid And for in consideration of the covenants and agreements herein after mentioned on the part of the said Henry Woodward to be kept and performed He the said Charles Homewood hath Covenanted Granted and Agreed And by these Presents the said Charles Homewood Doth for himself and his Heirs Covenant grant and agree to and with the aforesaid Henry Woodward his Heirs Executors Administrators and Assigns in manner and form following that is to say That the recited Mortgage and the Lands and Premisses therein Mentioned and every part and parcel thereof shall stand Chargeable and be burthened with and be Security for the Payment of the aforesaid sum of two hundred and Ninety Nine Pounds Sterling with Legal Interest thereon on the fifth Day of November Seventeen hundred and Seventy one over and besides the said Sum of Two thousand and forty four pounds and eight pence sterling the Principal Consideration Money of the said Mortgage And that the said sum of Two thousand and forty four Pounds and eight pence Sterling shall not be paid or satisfied or tendered or offered to be paid under the Condition or Proviso in the said Mortgage contained at any time before the fifth day of November (which) |
