(226) and Sale and the Conveyance thereby made should cease determine and be Null and utterly void any thing contained to the contrary thereof notwithstanding and the said Charles Homewood did thereby for himself his Heirs Executors and Administrators Covenant Promise and Agree to and with the said Henry Woodward his Executors Administrators and Assigns in manner and form following that is to say that the said Charles Homewood and his Heirs the said Bargained and Sold or meant mentioned or intended to be bargained and sold Lands and Premisses and each and every of them unto him the said Henry Woodward and his Heirs and Assigns against all manner of Persons whatsoever should and would Warrant and for ever defend And further that he the said Charles Homewood would well and truly pay and Satisfy unto him the Said Henry Woodward the aforesaid sum fo Two thousand and forty four pounds and eight pence sterling ^at^ before or after the said fifth day of November Seventeen hundred and Seventy five according to the said Condition or Proviso for Payment thereof And also that the said Henry Woodward his Heirs Executors Administrators or Assigns should & might on the fifth day of November then next ensuing or at any Time thereafter at his Pleasure enter upon have hold occupy possess and enjoy all and singular the said Bargained and sold Land and Premisses (except such part thereof as was then held and enjoyed by Ann Govane Gentlewoman the Mother of him the said Charles Homewood for the Said Dower of the Endowment of Thomas Homewood Esquire deceased her late Husband the Father of him the said Charles Homewood) and immediately upon the Death of her the Said Ann Govane might enter upon have hold occupy possess and enjoy such Part of the said Bargained and sold or meant mentioned or intended to be Bargained and Sold Lands and Premisses as was then held by her Dower as aforesaid and should and Might at his Will and Pleasure cut fell Sell or in any manner dispose of any or all the Timber Trees and other Woods being or growing on the said Premisses that is to say immediately on his Entry as aforesaid that he might so fell cut sell and dispose of the Timber Trees and other Woods growing and being upon the other parts of the said Premisses ^not^ and held by the said Ann Govane for her Dower as aforesaid and that immediately upon the Decease of the said Ann (Govane) |
