(37) purchased of John Willy & Matha his wife and Richard Simonds by the s.d W.m Smith by estimation fifty acres as by a Deed of Sale on the Records of Calvert County bearing date the twentieth day of June One Thousand seven hundred & nine relation being thereunto had will More at large appear togeather w.th all the appurtinances thereunto belonging To have and to hold the said Tracts and Parcells of Land last before menconed w.th the Appurtinances Granted & Confirmed by these p.rsents unto the s.d Kensley Jones his heirs & assignes to the only sole use and behoof of the s.d Kenley Jones his heirs & assignes for ever Provided allwayes and it is the true intent & meaning of these presents and of the Parties thereunto that if either the afd William Smith or Kensley Jones their heirs or assignes shall happen at any time hereafter to be Lawfully evicted of either of the s.d Estates for or by reason or means of any former Grant Bargaine Sale Morjage Joynter Dower Settlement Title or Incumbrance Whatsoever (excepted before excepted) that then this present Deed Feoffment & Exc.a & every Covenant Clause and Matter & thing contained therein shall Cease Determine and be Utterly Void & of No Effect & that then it may & shall be lawfull to & for the other of the s.d parties that is to say the s.d W.m Smith or Kensley Jones their heirs or assignes to renter into the premisses hereby exchainged & possess or repossess & enjoy the same as his or their proper Estate & Right Any thing in thes p.rsents containd to the contrary in (any) |
