37) on y.e back of Deed to Jn.o Hyde from Herculus Humer was thus written Aprill prov.l Court 1711 Came into Open Court Charles Carroll of the Citty of Annap.o Esq.r attorney in fact for the within Named John Hyde and for and on behalf of the said John Hyde and in his Name acknowledged to have had and reced full satisfaction & paym.t of the within Menconed Mortgage mony both principall and Interest and desired that y.e w.thin Mortgage may be made null & Void & Vacated upon Record w.ch is accordingly done Test John Beall Clk 99 x.d This Indenture made the fourteenth day of Aprill in the year of our Lord God one thousand seven hundred and eleven Between James Talbott of Castle Ruvy in the Kingdom of Ireland Esq.r by Charles Carroll his attorney for that purpose appointed of the one part and Jn.o Hance Stillman of Cæcill County Gentl of the other part Wittnesseth that the said James for and in Consider.a of the sume of twenty pounds Curr.t money of England to his said attorney well secured to be paid for the use of the s.d James hath as by these presents he doth by his attorney afd bargaine sell alien enfeoffe and Confirme unto him the said John Hans steelman all that tract or pcell ^or parcell^ of Land Called Steelmans delight Cont.a two hundred acres Lying and being aboute five Miles from Navigable River near Popemetan Creek Begining at a bounded poplar upon a Hill near the said Creek and runing thence west Eight Degrees northerly three hundred and Twenty per.s thence north eight deg.rs westerly one hundred and seventy per.s thence east fifty degrees southerly three hundred twenty and four per.s then south eight degrees easterly to the first marked tree Cont.a two hundred acres as afd more or Less To have and to hold the same unto him the said John Hance Steelman his heires and assignes he the said steelman yielding and paying unto him the said James the sume of eight shill yearly rent and the said James by his attorney afd doth hereby Covenant grant and agree to and w.th the said Steelman that he the said James the af.d Tract and premises thereunto belonging unto him the s.d Steelman and his heires and assignes ag.t all Manner of Claimes and demands whatsoever of him the said James or his heires or assignes save only the Rent so as afd reserved shall & will for ever warr.t & defend In Wittness whereof the s.d parties have hereunto Interchangably set their hand and seales the day & year first abovewritten sealed and d.d in presence of (the words of him the s.d James his heires or assignes enterlined Char.les Carroll between y.e 3.d & 4.th Line of the deed originall Deed att of James (seale) John Michcell Talbott Nich.o Jacob on the back of y.e s.d deed was thus written Viz.t (Aprill) |
