865) 891 And ministers civill and millitary and all other Inhabitants in our said Province and Teritory to be obedient aiding and assisting unto you the said Nathaniell Blackston in the execution of this our comission and of y.e powers and authorities therin contained and in case of your death or absence out of y.e said Province to be obedient aiding and assissting of such psons as shall be appointed by us to be Comander in Chiefe of the said Province To whome wee doe give and Grant Therefore by these p.rsents Give and Grant all and singular the powers and and authorities af.d to be executed and enjoyed by him during our Pleasure or untill your arrivall within y.e said Province of Maryland And if upon the death or absence of you the said Nathaniell Blackston our of y.e said Province of Maryland There be noe person comissionated or appointed by us to bee Comander in Chiefe of the said Province Our Will and Pleasure is That the Then p.rsent councill in That Province doe Take upon them the Administracon of the Governm.t and execute this comission and the severall powers herein contained And that the first councillor who shall be at the time of your death or absence Residing within y.e s.d Province of Maryland doe Preside in the said Councill w.th such Powers and Predeminencies as our former President hath used and enjoyed within the said Province or any other Plantations in America untill our Pleasure be further Knowne or your arrivall as af.d Lastly wee doe hereby Declare ordaine and appoint that you the said Nathaniell Blackston shall and may hold execute and enjoy the office and place of Captaine Generall and Govern.r in Chiefe in and over our said Province and Teritory of Maryland Together w.th all and singular the Powers and Authorities hereby Granted unto you Judicially upon your arriveall within the said Province and Publication of this our comission during our Will and Pleasure and that our comission to Francis Nicholson Esq.r to be Captaine Generall and Governour in Chiefe of our said Province and Teritory of Maryland doe thereupon cease and become voyd In Wittness Whereof wee have caused these our Letters to be made Pattents Wittness Thomas Arch Bishopp of Canterbury and the other Gaurdians and Justices of the Realme at Westminster y.e Nineteenth Day of October in the Tenth Yeare of our Reigne Chuts Per Breve de Private sigillo Prince Georges County fs The Deposition of Coll Ninian Beall Aged about seventy six years taken this twelfth Day of Aprill Anno 1698 The deponent came to a white oak and put his hand thereon and swore that he bounded the same for the N W Corner tree of a pcell of land called the Vale of Benjamin formerly laid out for M.r Benjamin Wells and after came to a white oak standing in the west line he saith he bounded a white oak in the said land but after finding it not to be you square ran one hundred and sixteen pches to another white oak for that purpose Charles Boteler being the survo.r Jurat Coram Nobis Robert Tyler Thomas Sprigg Jun.r Sam.ll Magruder |
