867 (840 William & Mary by the Grace of God of England Scotland France and Ireland King and Queen Defenders of the faith to our Trusty and well beloved Francis Nicholson Esq.r Greetting Wee reposeing especiall Trust and Confidence in the Prudence Courage and Loyalty of you the said Francis Nicholson out of our Especiall Grace Certaine knowledge and meere Motion have thought fitt to Constitute and appoynt and by these ⅓ doe Constitute and appoynt you the said Francis Nicholson to be our Cap.t Gen.ll and Gov.r in Cheife in and over our Province and Territory of Maryland in America and wee doe hereby require and Command you to doe and Execute all things in such Manner that shall belong unto yo.r said Command and the Trust wee have reposed in you according to the severall Powers & Directions granted or appoynted you by this Commission and the Instructions herewith Given you as by such further powers instructions or authorityes as shall at any time hereafter be Granted or appoynted you under our signet and signe Manuall or by our Ord.r in our Privy Councill and According to such reasonable Laws and statutes as are now in force or hereafter shall be made and Agreed upon by you with the advice and Consent of the Council and Assembly of our said Province under Yo.r Governm.t in such Manner and forme as is hereafter Expressed And Wee doe hereby Give and Grant full Power unto you the said Francis Nicholson after you shall have first taken an Oathe for the due Execution of the Office and Trust of our Captaine Generall and Gov.r in Cheife in and over our said Province and Territory of Maryland which our Councill or any five of them have hereby full power and Authority and are required to administer unto you to Give and Administer to Each of the Members of our said Councill the Oathes appoynted by Act of Parliam.t to be taken instead of the Oathes of Allegiance and Supremacy as allsoe the Test and the Oathe for the due Execution of theire places and Trust And Wee doe hereby Give and Grant unto you full power and Authority to suspend any of y.e Members of our said Councill from sitting voteing and Assisting therein if you shall find just Cause for soe Doeing and if it shall at any time happen that by the Death or Departure out of our said Province of Suspension of any of our Councillo.rs there shall be a vacancy in our said Councill any Three whereof are hereby appoynted to be Quorum Our Will and pleasure is that you signifye the same unto us by the first oppertunity That wee may under our signett and signe Manuall constitute and appoynt others in theire steads But that our affaires at that distance may not suffer for want of a Due Number of Councillo.rs if ever it shall happen that there be less then seven of them resideing in our said Province Wee doe hereby Give and Grant unto you full Power and Authority to Choose as Many psons out of the ^principle^ freeholders Inhabitants thereof as will make up the full Number of our said Councill to be Seven and we more which psons by virtue of such Choyce shall be to all intents and purposes Councillors in our said Province untill they shall be Construed by us or that by the Nomination of others by us under our signe Manuall and signett the said Councill shall have seven pson in it and wee doe hereby Give and Grant unto you full power and Authority with the advice and Consent of our said Councill from time to time as need shall require to summon and Call Generall Assemblyes of the Freeholders within Your Governm.t According to the Usage of our Province and Territory of Maryland Our will and pleasure is that the psons thereupon duely Elected by the Majo.r part of the Freeholder of the respective Countyes and Places and soe returned and having before theire sitting taken the Oathes appoynted by Act of Parliament to be taken instead of the Oathes of Allegiance and Supremacy as allso the Test which you shall Commissionate fitt psons under our Seale of Maryland to administer unto them and without takeing which none shall be capable sitting though Elected shall be called and told the Generall Assembly of that our Province and that you the said Francis Nicholson by and with the advice and Consent of our said Councill and Assembly or the Majo.r part of them respectively have full power and Authority to make Constitute and Ordaine Laws Statutes and Ordinances of the Publick Peace Wellfare and Good Governm.t of our said Province and of the People and Inhabitants thereof and such others |
