(792) 812 Maryland fs To all Christian People to whome these p.rsents shall come Greetting in our Lord God Everlasting Know yee that for and in Consideration that Edward Boothby and Jones Philips both of Baltemore Gent have become w.th and for me Benjamen Wells of the sd County in the penall sum of three thousand pounds sterl pursuant to an Act of Assembly of this Province as I am Executor of the last Will and Testament of Coll George Wells my father late decd have for theire Indemnity from the sd Bond Assigned sould aliend and made over And I doe by these p.rsents assigne sell alien and make over unto them the sd Edward Boothby and James Philips all the Lands and Tenements Goods and Chattells whatsoever of me the sd Benjamen whether the same be in posession Reversion or remainder or whether the sd Goods be such as are Come to me by the Executorship of my fathers will or otherwise To have and To hold all the Lands and Tenem.ts Goods and Chattells and premises afd unto them the sd Edward and James theire heires and Assignes for ever And whereas I the sd Benjamen being fully sensible of my Incapacity to manage the trust reposed in me by my said father in his said will being frequently visited by and subject to fitts by which I am a Considerable time after the same rendred uncapable of Manageing any business or Concerne though but of small weight or moment have this day Impowerd and Authorized the sd Edward & James or either of them to act doe performe fullfill and execute finish and compleat in my name all matters and things relating to the sd Executorship as in and by the sd Instrument relation being thereunto had it doth and may more at large appear I doe further hereby for and in Consideration of their the sd Edward & James Trouble and loss of time and and about the execution and management of the sd matters relating to the Executorship afd bind me my heires and adm.rs to allowe them at the rate of two pounds ten shill ster for every hundred pounds they shall receive of the sd Estate and the like sum for every hundred pounds sterl they shall pay out of the same and soe proportionably for a Greater or Lesser sum Besides all Extraordinary and Incident Charges to the Compleating and finishing the sd Executorship Provided allways and it is the true Intent and meaning of these p.rsents that if I the sd Benjamen shall clearly and to all intents and purposes indemnifye and save harmless the sd Edward & James from the Bond they have soe as afd entred into w.th and for me as allso pursuant to the power by me given them pemitt them perfectly and compleatly to finish the sd Executorship in my name without lett or Interruption and allowe them the afd two pounds ten shill p Cent for receiving and the same for paying as afd that then this sale and the Alienation thereby made and the covenants and articles therein contained shall be voyd and of noe effect otherwise to be full and absolute to all Intents Constructions and purposes In wittness whereof I have hereunto sett my hand and seale this sixth day of Aug.t 1697 Sealed and Deliverd (the words or either of them being before interlined between the seventh and eighth lines) in p.rsence of Benjamen Wells (seale) Char Carroll R Gouldesborough |
