800 (781 Of all and singular the before granted Land & p.rmisses with y.e Appurtenances unto & upon the said Alice Austin her heires and assignes be it by Fine or Fines Recovery or Recoverys Feoffem.t Deed or Deeds Inroled or not Inroled y.e Inrolem.t of these p.rsents Release Confirmacon or by all or any of them or by any other ways or means whatsoever as y.e said Alice Austin her heires assigns or by her or their councill Learned in y.e Law shall be reasonablely Devised Advised or Required In Wittness whereof y.e parties to these p.rsent Indentures their hands and seales Interchanablely have sett the Day and Year first above Written Signed Sealed and Delivered Robert Smith sealed In the p.rsence of S Watkins R Gouldesborough May y.e 20.th 1697 The within deed Acknowledged to be y.e Act and Deed of y.e within Robert Smith before y.e subscribers Recorded May y.e 29.th the day and year above Tho Tasker Phill Hoskins Maryland fs This Indenture Made the tenth Day of Novemb.r Annoq.r Domi one thousand six hundred ninety and six made Betweene Richard Bishop of Kent County Gent his heires Ex.rs Adm.rs of y.e one part & Robert Smith his heires or his Assignes of y.e other part Wittnesseth that the s.d Richard Bishop for and in Consideracon of the sum of forty thousand pounds of tobacco to him in hand paid Att And before the sealing and delivery hereof The Receipt whereof hereby Acknowledge and himself therewith and of every part and parcell thereof fully satisfied contented and paid And do by these p.rsents Acquitt and Discharge the said Robert Smith his heires or his Assignes And every of them by these p.rsents for ever And for Divers good causes and consideracons him y.e s.d Richard Thereunto more especially moveing have given Granted And by these p.rsents Doth give grant bargain sell Allien Infeoff and Confirm from him and his heires for ever unto y.e s.d Robert Smith his heires or his Assignes for ever These severall parcells of Land Amounting to in all eight hundred acres being pursuant and according to a private Act of Assembley for that purpose Made And provided viz.t two hundred and fifty acres called Bramtont butted and bounded According to patten two two hundred Acres called Bishops Addition one hundred and twenty Acres called sittuate on y.e Island of Kent And four hundred and thirty Acres part of a Tract of Land Called Bishops Out Lett Beginning at a Marked Locust Tree being y.e first bounded Tree of Courseis Point Running North North East four hundred perches w.th Bishops Adition then west w.th y.e s.d Land one hundred and fifty pches to a pcell of Land called Branton then w.th Branton to Reeds Land then w.th Artifitiall lines to make up four hund.rd & 30 acres All whch severall Tracts containeth eight hundred Acres according to the seve.rll meets and bounds of y.e s.d Tract As alsoe one other Tract of Land called y.e Mistake containing four hundred Acres sittuate on Coursegall Creeke laid out for him y.e said Richard Bishop butted & bounded according to the Certificate of survey thereof To have and To hold all y.e above severall Tracts and parcells of Land Above Menconed According to their severall meets and bounds together w.th all and singular y.e Rights profits priviledges and benefitts thereunto belonging Royall Mines Excepted unto him the s.d Robert Smith his heires or his Assigns for ever free & clear from all manner of Incomberances whatsomever to his and their only proper use and behoofe for ever And y.e s.d Richard doth Covenant for himself and his heires to and w.th y.e s.d Robert Smith his heires or his Assigns to save defend and keep harmless y.e s.d Robert Smith his heires or his Assigns for ever ag.t all manner of psons whatsomever Lawfully claiming shall and will for ever War.t and defend by these p.rsents y.e Rents and services which henceforth shall grow Dow and payable to y.e Chief Lord or Lords of the fee or fees only excepted and foreprised In wittness whereof we have hereunto Interchangably sett our hands and affixed our seals The day and Year first above written Richard R Bishop Sealed and Delivered Recorded May y.e 29.th 1697 sealed in p.rsents of May y.e 20.th 1697 Thomas Collins John Turner Then came Richard Bishop before y.e Justices of y.e prov.ll Court Richard R B Bellum in Court sitting and acknowledged y.e within Indenture to be his act and deed Chr Gregory Clk Ass.tt |
