796 (777 Navall Offic.rs and from time to time save Defend and keep harmless y.e s.d Fra Nicholson Esq.r from all Damage loss and Charges that he y.e s.d Francis shall sustaine at any time by reason of y.e s.d Dentons nonpformance of his s.d Office (soe long as he shall enjoy y.e same) as is in y.e s.d severall laws enacted and Ordained Then y.e above Obligacon to be voyd and of none effect otherwise to be and remaine in Full force and virtue sealed and delivered Hen Denton (X) sealed in y.e p.rsence of us Charles Carroll (X) sealed Thomas Lawrence Edward Boothby To his Ex.cy S.r Edmond Andress Knight Cap.t Gen.ll and Govern.r in Chief of his Majesties Colloney of Virginia The Humble Peticon of Phillip Clarke of S.t Marys County in his Majesties Province of Maryland Most Humbly sheweth unto y.r Ex.cy That whereas y.r Petitioner in y.e late Revolution was Admitted and sworn an Attorney in y.e Prov.ll Court and in severall of y.e County Courts of y.e s.d Province and in y.e same did practice till y.e tenth day of Agust last at which time y.r Petitioner received summons to Appeare and serve his Majestie as a justice of y.e Prov.ll Court upon which summons y.r Petitioner did most humbly Petition his Ex.cy y.e present Govern.r that for as much as he had been allways ready to serve his most sacred Majestie in y.e late Revolution and since and that y.e practice of an Attorney was that upon which y.e whole mentainance of his family did depend did therefore most humbly pray that he might not be discharged from his s.d Office of an Attorney by being made and of y.e s.d Justices Neither of which Reasons did prevaile w.th his Ex.cy soe that y.e Petitions in Obedience to y.e s.d s.d Commission did Accept of y.e same hoping by this submission to continue his Practice in y.e sev.ll other for what y.e Petition.r knows not except for refusing as Judge of y.e s.d Courte to grant a Judgm.t ag.t Coll Jn.o Coode Contrary to Law did for four days together come downe to y.e Prov.ll Court and sitt there in his proper pson where he did endeavour to prove y.r Peti.r Guilty of some crime that might deserve Imprisonm.t but y.e evidences after all his threats not swearing as he desired was disapointed of his designe did Afterwards upon y.e 14.th day of Decemb.r by and Ord.r of Councill dismiss y.r Peti.r from being a Justice of y.e s.d Court as likewise from pleading in any of y.e Courts of y.e s.d Province and issue out a Proclamacon promising any pson a reward of twenty pounds sterling that would swear y.r Petitioner was Endeavouring to Raise a Rebellion in S.t Marys County; from which grivious Oppression and Unheard of Proceedings y.r Petitioner most humbly prays y.e Ex.cy that he may be protected in this his Majesties Collonye of Virginia Under y.e quiet and peaceable Governm.t of y.e Ex.cy that soe y.e Petitioner may be enabled to make his Just Complaint to his Most Sacred Majestie And as in duty bound shall pray for y.r Ex.cys long and Happy Governm.t Under his Most Sacred Majestie Maryland fs We y.e subscribers being Members of Maj.ts honoble Councill of this Province doe hereby solemnly declare that we have not at any time either directly or indirectly Recieved any directions or Command from his Exn.cy the p.rsent Govern.r to doe any illegall act or thing whereby Justice might be pverted or to regulate or square our actions contrary to y.e station and place of his Maj.ties Councill.rs in w.ch Majestie hath been pledged to place us here; Given under our hands this 15.th day Decemb.r in y.e eighth year of his Maj.ties Reigne &c.a anq.r d.mi 1696 Jn.o Addison Jn.o Courts Tho Brooke |
